El enfoque con el que la autora aborda este tema es eminentemente práctico, analizando problemas que hasta ahora habían pasado desapercibidos, bien porque el tratamiento de la cuestión había sido eminentemente dogmático, bien porque se había hecho una lectura sesgada del contrato de trabajo internacional. Es el caso del tratamiento que dispensa al problema de la calificación del contrato o de la identificación de las normas imperativas e internacionacionalmente imperativas que limitan la capacidad rectora de las partes. Marta Casado Abarquero es profesora de Derecho Internacional Privado de la Universidad de Deusto y abogada en ejercicio. Con la publicación de esta monografía la autora culmina un trabajo de investigación que tiene por base su tesis doctoral y para cuya redacción han sido determinantes las estancias de investigación en la Harvard Law School (Cambridge), el Max Planck Institut für ausländisches und internationales Privatrecht (Hamburgo) o el Tribunal de Justicia de la Unión Europea.
