La dignidad humana no está circunscrita en su existencia y amplitud a los derechos que le han reconocido el Estado, pues independientemente del reconocimiento jurídico o legal, el ser humano es inherentemente digno. Sin embargo las tradiciones culturales y jurídicas influyen en la esfera de actuación que jurídicamente puede ejercitar el ser humano. Es por esto que la presente tesina procede con una exploración del origen histórico y jurídico de la autonomía de la voluntad. Posteriormente se expone brevemente las corrientes bioéticas a las que se asemejan la práctica médica en Estados Unidos y México. Se procede a hacer una comparación de los orígenes legislativos de la protección a la salud y su desarrollo en lo que respecta a la autonomía del paciente en la práctica médica en ambos países. Lo anterior permitirá visualizar algunas similitudes y diferencias en la protección legal que se concede al paciente con respecto al ejercicio de su autonomía para la toma de decisiones respecto a su tratamiento médico".
