Book excerpt: La Sentencia del Tribunal Supremo de 30 de junio de 2014 señala que en la actualidad se ha producido un cambio progresivo de la concepción tradicional de la cláusula rebus sic stantibus, lo que determina que desde un marco de aplicación sumamente restrictivo o excepcional, ha de transitarse hacia una configuración que denomina “plenamente normalizada”, con una progresiva objetivación de su fundamento técnico de aplicación que considera “claramente compatible con el sistema codificado”, lo que significa ni más ni menos que tener en cuenta el orden público económico, la regla de “la conmutatividad del comercio jurídico como expresión de un equilibrio básico entre los bienes y servicios que son objeto de intercambio”, y por último, hasta el propio principio de buena fe. No sé si podremos decir que con esta Sentencia habrá un antes y un después en la jurisprudencia sobre la alteración extraordinaria de las circunstancias contractuales. Personalmente, no me parece que un contrato publicitario celebrado en agosto de 2006 y con una duración prevista de cuatro años pueda verse afectado por la doctrina de la cláusula cláusula rebus sic stantibus en términos diferentes a los que la jurisprudencia del Tribunal Supremo había venido señalando en los últimos años. Pero lo que sí puedo afirmar, sin ningún género de duda, es que la presente monografía está llamada a constituir una herramienta de referencia imprescindible para cualquier jurista que quiera conocer la doctrina de la alteración extraordinaria de las circunstancias contractuales y deducir si cabe aplicarla o no en cada supuesto práctico que se le plantee. El análisis que el autor lleva a cabo comienza con la evolución histórica y prosigue con el estudio del Derecho anglosajón, la doctrina francesa de la imprevisión, la italiana de la onerosidad sobrevenida y la alemana de la base del negocio para después acometer el examen de la jurisprudencia y doctrina españolas y de las propuestas europeas contenidas en los Principios de Derecho Contractual Europeo (PECL), en el Proyecto de Marco Común de Referencia (DCFR), en la Propuesta de Reglamento Europeo relativo a una Normativa Común de Compraventa Europea (Common European Sales Law). Finaliza con los trabajos de las Secciones Civil y Mercantil de la Comisión General de Codificación. La información es, pues, absolutamente exhaustiva, y el libro que tiene el lector en sus manos, de inexcusable consulta y presencia en cualquier biblioteca de Derecho de contratos.
