Les textes relatifs à l’indemnisation et à la prévention des risques professionnels comptent, aujourd’hui, parmi les fondements de notre droit social. Ils dotent l’Etat d’une compétence régalienne de veille sanitaire. Les récentes mises en cause de l’administration pour carence dans la prévention des risques liés à l’amiante, ainsi que les revendications contemporaines d’une société marquée par les concepts de risque, révèlent la complexité de la mission publique actuelle. Celle-ci, parce qu’elle s’exerce en parallèle de celle des employeurs - premiers garants de la santé des travailleurs - s’inscrit dans le contexte particulier de l’entreprise et engendre une relation triangulaire originale. Les fondements de cette mission sont à rechercher dans l’idée que la protection de l’intégrité physique des travailleurs constitue la part irréductible d’un droit du travail imposé par l’Etat ; d’un « droit public du travail » face au droit privé de l’entreprise. C’est, alors, la traditionnelle mission de police dévolue à la puissance publique qui transparaît. Mission de police classique, marquée par le concept de prévention, mais qui porte sur un objet particulier, la protection de la santé des travailleurs. Ce « droit public du travail » se traduit par la mise en œuvre de mécanismes propres à l’administration qu’il s’agit d’étudier tout en s’interrogeant sur leur pertinence contemporaine. En intégrant désormais tous les aspects de la santé publique et en visant l’ensemble des salariés, la prévention et la réparation des risques professionnels, telles qu’elles avaient été conçues en 1890, ne paraissent plus constituer les instruments d’une protection suffisante."

In the spirit of Karl Polanyi, the well-known scholar who described the rise of market-based societies, we are led to wonder if we are witnessing a new “Great Transformation of Work”, on such a scale that it might change the very meaning of work in our society, and even its anthropological connotations. Accordingly, this volume investigates and discusses the different aspects of this transformation from a comparative perspective. In order to propose better solutions to cope with these changes, it is necessary to analyze their ongoing dynamics. Lawmakers, unions, scholars and practitioners are all called to do their part in order to achieve the goals of sustainability and fairness of our economic systems.

It is a document of advocacy/indictment and lobbying in favor of the development, protection and improvement of the social conditions of the elderly and persons with disabilities in Africa in terms of health, food, housing, environment, social protection, income maintenance, employment and education, given their increasing numbers in relative and absolute terms. The issue of socially vulnerable people is thus brought to the forefront of important, if not permanent, political-social and scientific concerns. It is the subject of recurrent investigations and reflections within the special mechanism of the African Union, the Working Group on Elderly Persons and Persons with Disabilities of the African Commission on Human and Peoples' Rights. The initial assignment is to build legal, psychological, socio-anthropological and political vehicles in order to initiate positive change and sustainable protection of VHPs, as well as customary protocols for their valorization in African cultures and traditions.
