Book excerpt: One of the principal tasks for legal research at the beginning of the 21st century is to reconstruct the understanding of the relationship between the legal system and the market order. After almost three decades of deregulation driven by a belief in the self-equilibrating properties of the market, the financial crisis of 2008 has reminded everyone of the fundamental truth that markets have legal and institutional foundations, without which they cannot effectively function. The chapters in the present volume are the result of work by a group of legal scholars which began in the mid-2000s, at a time when the shortcomings of deregulatory policies were becoming clear in a number of contexts. The chapters address the question of how the language of contract law describes or conceptualises the market order and the relationship of the law to it. The perspectives taken are, in turn, historical, comparative, and context-specific. The focus of the book is on a foundational idea, the concept of capacitas, which signifies a status conferred upon citizens for the purpose of enabling them to participate in the economic life of the polity. In modern legal systems, 'capacity' is the principal juridical mechanism by which individuals and entities are empowered to enter into legally binding agreements and, more generally, to arrange their affairs using the instruments of private law. Legal capacity is thereby the gateway to involvement in the operations of a market economy.

Analecta 21 is a varied number. Three themes are developed covering exegetical, historical, sociological, theological and philosophical fields. Book excerpt: All over the world, in the most varied contexts, contemporary theatre is a rich source for increasing the visibility of communities generally perceived by others as minorities, or those who see themselves as such. Whether of a linguistic, ethnic, political, social, cultural or sexual nature, the claims of minorities enjoy a privileged medium in theatre. Perhaps it is because theatre itself is linked to the notions of centre and periphery, conformism and marginality, domination and subjugation – notions that minority theatre constantly examines by staging them – that it is so sensitive to the issues of troubled and conflicted identity and able to give them a universal resonance. Among the questions raised by this volume, is that of the relationship between the particular and the more general aims of this type of theatre. How is it possible to speak to everyone, or at least to the majority, when one is representing the voice of the few? Beyond such considerations, urgent critical examination of the function and aims of minority theatre is needed. To what kind of public is such drama addressed? Does it have an exemplary nature? How is it possible to avoid the pitfalls and the dead end of ghettoization? Certain types of audience-specific theatre are examined in this context, as, for example, theatre as therapy, theatre as an educational tool, and gay theatre. Particular attention is paid to the claims of minorities within culturally and economically dominant western countries. These are some of the avenues explored by this volume which aims to answer fundamental questions such as: What is minority theatre and why does theatre, a supposedly bourgeois, if not to say elitist, art form, have such affinity with the margins? What if, particularly in contemporary society, the theatre as a form, were merely playing out its fundamentally marginal status? The authors of these essays show how different forms of minority theatre can challenge cultural consensus and homogenization, while also aspiring to universality. They also address the central question of the place and status of apparently marginal forms of theatre in the context of globalization and in doing so re-examine theatre itself as a genre. Not only do they illustrate how minority theatre can challenge the dominant paradigms that govern society, but they also suggest their own more flexible and challenging frameworks for theatrical activity.

Pourtant, la politique étrangère, celle de la défense ou encore la politique sociale (pour ne rien dire d'une politique économique) sont autant d'enjeux et de défis, aujourd'hui comme demain. Et ils sont de taille. L'Europe est inachevée, aussi, parce que, au-delà des adhésions annoncées de la Bulgarie et de la Roumanie, puis de la Croatie, la question du sud-est européen reste posée comme l'est celle de la vocation de la Turquie à rejoindre ou non l'Union. L'Europe est encore inachevée en tant que projet. Europe des patries, Europe fédérale, confédérale, des régions, des peuples ? En bref, quelle Europe, aujourd'hui qu'il n'est plus censé exister une « Autre Europe » ? Inachevée sans aucun doute, l'Europe est à inventer ou mieux, à réinventer. Et cet inachèvement même réclame sans doute une pédagogie qui ne soit ni celle de l'apologie sans discernement ni celle de la critique aveugle.

But the remembrance of the fall of the Berlin Wall coincided with another event of global importance that caught much less attention: the 250th anniversary of Napoleon Bonaparte’s birth. There is an undeniable historical and philosophical dimension to this coincidence. Napoleon’s appearance on the scene of world history seems to embody European universalism (soon thereafter in the form of a ‘modern’ imperial project); whilst scholars such as Francis Fukuyama saw in the events of 1989 its historical fulfilment. Today, we see more clearly that the fall of the Berlin Wall stands for an epistemic earthquake, which generated a world that can no longer be grasped through universal concepts. Here, we deal with the idea of Europe and of its relation to the world itself. Picking up on this contingency of world history with an ironic wink, the volume analyses in retrospect the epoch of European universalism. It focusses on its dialectics, polemically addressing and remembering both 1769 and 1989. L’année 2019 a été marquée par le 30e anniversaire de la réunification de l’Allemagne, éclipsant un autre événement d’envergure mondiale : le 250e anniversaire de Napoléon Bonaparte. La dimension philosophico-historique de cette coïncidence ne peut pourtant pas être négligée : si l’arrivée de Bonaparte sur la scène de l’histoire mondiale semble incarner l’avènement de l’universalisme européen (bientôt amené à prendre sa forme « moderne » et impériale), certains penseurs ont suggéré, avec Francis Fukuyama, que « 1989 » marquait son accomplissement historique. Aujourd’hui, il apparaît au contraire que la chute du mur de Berlin a été un véritable tremblement de terre épistémique, et rendu inopérants les concepts universels. Dans le monde d’après, c’est à l’idée d’Europe et à sa relation au monde que nous avons affaire. Revenant par un geste ironique sur cette contingence historique, le présent volume se veut une analyse rétrospective de l’époque de l’universalisme, dans toute la dialectique que les commémorations de 1769/1989 ont fait surgir.
