Book excerpt: Il presente volume si propone di analizzare e descrivere il ruolo assunto dalla comparazione nell’attuale contesto socio-economico e politico, nel quale le influenze della globalizzazione, da un lato, e le spinte di armonizzazione delle realtà statuali provenienti dalle organizzazioni sovranazionali, dall’altro, risultano sempre più evidenti, tali da offrire un diverso punto di vista al comparatista, non più limitato al solo studio del diritto degli Stati e delle differenze di ciascuna cultura giuridica. Premesse brevissime considerazioni sul diritto privato comparato e sul ruolo della comparazione, vengono analizzate le nuove sfide che attendono il comparatista, ritenendosi ormai superato l’originario approccio alla comparazione quale studio di diritti stranieri, catalogati in modelli o in famiglie, e considerati sostanzialmente isolati ed autoreferenziali. La seconda parte dello studio cercherà, nell’ambito della cornice innanzi evidenziata, di cogliere il ruolo del diritto comparato nella giurisprudenza, ove risulta svolgere un ruolo che va assumendo sempre più una valenza rilevante. Infine, per completezza di indagine, l’attenzione verrà puntata su di una fattispecie specifica, quella della responsabilità per fatto illecito, nella quale permangono le maggiori differenze tra i singoli sistemi giuridici, sia di common law che di civil law, rappresentando gli elementi caratterizzanti il sistema della responsabilità extracontrattuale dei maggiori sistemi giuridici: Regno Unito, Stati Uniti D’America, Francia, Germania ed Italia.

Il risultato è un rimescolamento delle sensibilità con cui ci si accosta al raffronto tra esperienze giuridiche, del resto in linea con una fase storica per molti aspetti caratterizzata da giudizi critici sulla globalizzazione. Gli autori di questo volume si sono confrontati su questi aspetti in chiave critica e mettendo in luce differenti sensibilità nei diversi campi del sapere giuridico: dal diritto privato al diritto al diritto pubblico, passando per il diritto del lavoro.
