To this end, the relevant market has been analysed along the structure conduct performance paradigm. Additionally, the existing trends, e. g. the changing consumer preferences, the changing technological standards, and an increasing number of independent service chains, were investigated to integrate the dynamics into the model. In this context the meaning and the impact of the regulation have been detailed with respect to consumer welfare.The analyses have shown that the new regulation complies with the guiding principles of competition policy and thus fosters competition in the industry. This stands in contrast to its predecessors, which were influenced by lobbying of the car industry and had thus laid the foundation for a heavily regulated business. As shown in this paper, a leap towards increased consumer welfare has been made by weakening the market power of the industry. Among others, the separation of sales and services, the permission of multi-brand outlets and the ban of price discrimination can be named as examples for reforms brought forward in the regulation. Furthermore, the so-called location clause will be abolished as of October 2005, which means that dealerships are allowed to open new outlets anywhere in the common market without the consent of the manufacturer. However, in the course of disallowing vertical restraints, of which some had previously helped to secure efficiencies in the value chain, a relative welfare loss has also developed. For instance, the increased free-riding issues could inspire a development to the detriment of the consumer and the convergence of prices at a high level could be disadvantageous to consumers in low income member states. Although the regulation has already come a far way, the critique that is voiced at the end of this paper, shows that there is significant room for improvement, once the regulation expires in 2010. Key points are the price convergence towards the level of the high price countries, some inconsistencies in the regulation and a possible loss of intangible consumer welfare. In the end whether the additional welfare surplus outweighs the new welfare loss has to be decided on a per country basis.

This impressive fact describes only a small part of one of the biggest industries in the EU. The European car industry is described as a "national champion" among EU competition law experts. However, even the best industry is nothing without an efficient distribution system. Distribution of motor cars in the EU has been governed for nearly 20 years by the legal device of block exemption regulations. The latest block exemption, Regulation 1400/023, came into force on 01 October 2002 and brought fundamental changes. This essay intends to analyse these changes and to predict their likely impact on the car distribution sector. For that purpose it is first necessary to describe the present distribution systems used by car manufacturers throughout the EU (A.I.), to outline the approach of EC competition law towards these specific distribution systems and to explain the Commission's general policy of granting block exemptions (A.II.). Part B of this paper is concerned with specific issues regarding the new block exemption. Major changes are highlighted and compared with the former regulation. The likely impact of the new regime on the distribution systems in the EU will be evaluated in part C. By taking into account current available data and trends in the motor industry I will give a projection of what outcome the new regulation may lead to.

Book excerpt: A key decision in transportation supply chain management is the determination of product delivery routes to reach customers as well as the vehicle sizes utilised on each route. The current paper delivery activities at P.T. Tjiwi Kimia Paper Mill may not be optimal in terms of cost indicating room for improvement by either adjusting the routes traversed or examining changes to the vehicle sizes. The NP-hard problem to determine the optimal product delivery routes utilising vehicles of different capacities according to specified time windows is known as the capacitated vehicle routing problem with heterogeneous vehicles and time windows (CVRPHTW). The behaviour of the delivery problem faced by the company is represented mathematically utilising extended two-commodity flow models by considering multiple vehicle sizes and hard time windows as well as road classes as an additional constraint. The models were tested on various benchmark instances from the HVRP website of Duhamel, Lacomme and Prodhon (2016) and the company with satisfactory results. Implementing the results of CVRPH models will reduce the weekly total cost from around IDR 14.5 million to around IDR 10 million which is equivalent to a 31 percent weekly savings although there are six more routes compared to the existing delivery activities. More even utilisation in the size of the vehicles will result as small vehicles will be required to access low-class roads to comply with government regulations. This also means that the cost reduction in carrying a larger quantity of the commodity to serve more distributors cannot be justified by the increase in the amount of fuel consumption on large vehicles.
