Book excerpt: Transformations to the criminal justice system in Western societies are often linked with broader social and cultural changes, and this work presents the recent changes in juvenile justice in Canada and nine European countries and the sociopolitical context in which they take place. The study provides a comparison of the sentencing practices of each country, focusing on three dimensions related to the sanction practices: the custodial sanctions, the alternative sanctions, and the extension of the judicial thinking into relative fields such as school, training, and social policies. With clear and thoroughly developed research methods, this analysis illustrates that changes in juvenile justice policies are not specifically the result of differences in crime rates or the evolution of deviant youth behavior, but rather the effect of complex interactions with a variety of social, economical, cultural, and political factors.

The last few decades have witnessed major debates over youth justice policies. Juvenile and youth justice legislation has been reviewed in a number of countries. Despite the fact that new perspectives, such as restorative justice, have emerged, the debates have largely focused on issues that bring us back to the inception of juvenile justice: namely whether youth justice ought to be more akin to punitive adult criminal justice, or more sensitive to the welfare of youths. This issue has been at the core of policy choices that have given juvenile justice its orientations since the beginning of the twentieth century. It also gave shape to the evolution that paved the way for the creation of juvenile courts in the nineteenth century. Understanding those early debates is essential if we are to understand current debates, and place them into perspective. Based on primary archival research, this comprehensive study begins by presenting the roots, birth and evolution of juvenile justice, from the nineteenth century up to the beginning of the twenty-first. The second part deals with nineteenth century responses to juvenile delinquency in England and Canada, while the third focuses on the welfare orientation that characterized juvenile courts in the first half of the twentieth century in Switzerland, the Netherlands, Germany and Belgium. Finally, the fourth part focuses on the perspective of the youths and their families in Belgium, France and Canada.

Les principes qu'elle énonce ont permis d'élaborer dans les deux pays, l'ensemble de la législation pénale sur l'enfant auteur d'infraction. Trois parmi eux paraissent essentiels : à savoir la rééducation et la réinsertion, la spécialisation, et la continuité de l'intervention. Telle qu'elle se présente, la justice pénale se caractérise par un renversement des perspectives par rapport au droit commun. En ce sens, le mineur reconnu coupable d'infraction n'est justiciable que des juridictions spéciales. Mais, cela ne signifie pas que le législateur ivoirien et son homologue français ont légiféré très exactement de la même façon en matière de droit pénal des mineurs. Si en France, les réformes de la législation relative à la minorité ont permis une amélioration du statut de l'enfant délinquant et un renouvellement significatif des réponses à la délinquance des jeunes, il n'en va pas de même en Côte d'Ivoire. Aucune réforme n'a été enregistrée depuis 1981. Ainsi, les juridictions sont-elles réduites à se contenter de quelques dispositions du code pénal et du code de procédure pénale (). Book excerpt: Depuis une vingtaine d'années, on constate dans une majorité de pays européens une mise en cause des poli-tiques sociales préventives traditionnelles et du fonctionnement de la justice des mineurs sous régime du Welfare dans un grand nombre de pays. En nous appuyant sur ce constat nous avons - dans le cadre d'un séminaire du GERN qui s'est déroulé entre 2003 et 2006 - testé une hypothèse concernant l'influence croissante de l'idéologie néo-libérale dans la production législative pour les mineurs et dans le fonctionnement des tribunaux pour enfants. Seize chercheur(e)s provenant de treize pays européens ainsi qu'un chercheur du Canada ont travaillé sur cette hypothèse et c'est le résultat de ce travail collectif qui est aujourd'hui présenté.
