Book Illusions of Liberalization

Download or read book Illusions of Liberalization written by Benn Steil and published by Chatham House (Formerly Riia). This book was released on 1995 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: Rapidly rising share prices in the 1980s served to hide significant inefficiencies in the Japanese securities markets, many of which derive directly from the operation of the regulatory system. While these inefficiencies are becoming increasingly costly and transparent in the more sober market environment of the 1990s, the regulatory structure at the heart of the problem remains fundamentally untouched. The European Community, meanwhile, is working to construct a Community-wide regulatory umbrella for securities markets, and is in danger of succumbing to the most damaging tendency of the Japanese authorities. This is to view the markets not in terms of their ultimate services, but rather in terms of the interests of incumbent service providers. Directives which are supposed to facilitate free and open cross-border competition are instead being used to protect Member State producer interests.

Book The Formation and Transformation of Securities Law in Japan

Download or read book The Formation and Transformation of Securities Law in Japan written by Andrew Pardieck and published by . This book was released on 2015 with total page 91 pages. Available in PDF, EPUB and Kindle. Book excerpt: It has been a tumultuous decade for Japanese securities markets. The collapse of the Bubble and advent of the Big Bang have reshaped the markets and spurred significant foreign investment. The newspapers are filled with accounts of mergers, acquisitions, and bankruptcies. Less widely reported, but equally important, has been the dramatic shift in Japanese securities law. Prior to the 1990s, private enforcement of Japanese securities law was “virtually non-existent.” The collapse of the Bubble, a regulatory vacuum and unsatisfactory alternative dispute resolution changed this. There has been a litigation explosion resulting in new judicial norms. A proactive judiciary has imposed duties on securities companies and created private causes of action for investors without basis or counterpart in the Japanese Securities Exchange Law. These judicial norms, more than administrative or private norms, have come to regulate the retail securities markets. As with previous periods of judicial activism, the central government has stepped in with new legislation. However, in contrast to earlier retrenchments that removed disputes from the purview of the judiciary, the Diet has codified the new private causes of action and reinforced the role of the judiciary. The changes in Japanese securities law are illustrative of a remarkable shift in Japanese law and present an opportunity to better understand the changing roles of administrative agencies and the judiciary in Japan. These changes also present opportunities, as well as hidden pitfalls, for foreign financial institutions operating in Japan. This paper explores an important area and period of Japanese law that has thus far received little attention.

Book excerpt: The Australian legal and regulatory framework for securities markets exhibits a high level of compliance with the International Organization of Securities Commissions (IOSCO) Principles. A few remaining concerns need to be resolved, including some identified in the 2006 assessment. Australian Securities and Investments Commission’s (ASIC) operational independence and sufficiency of resources are overarching concerns which impair its ability to discharge its supervisory functions adequately and effectively across the entire regulated population.

Book excerpt: This Technical Note discusses the findings and recommendations made in the Financial Sector Assessment Program for Japan in the areas of regulation and supervision of securities firms. The supervision of the two major Japanese securities groups and the Japanese subsidiaries of global banking groups deserves special attention, given the domestic and cross-border interconnectedness of these firms. The authorities should continue to ensure that the supervisory teams for the major Japanese groups have access to sufficient number of experienced staff. It is also important to continue to enhance the existing international cooperation in the supervision of Japanese firms’ overseas operations and foreign-owned firms’ activities in Japan.
