Book excerpt: This study investigates where and when last-in-first-out permanent layoff policies seem to go hand in hand with compensation policies under which the net value of senior workers appears to be less than that of their junior peers. The investigation relies upon both the approximately 260 usable responses to a survey we mailed out to a sample of U.S. firms and microdata from the computerized personnel files of a major U.S. corporation. Our findings for U.S. companies outside of agriculture and construction lead us to the following three conclusions: (1) For most employees, it appears that protection against job loss grows with seniority, although net value to the firm does not.(2) While a very sizeable percentage of nonunion workers may be covered by implicit employment contracts which give more protection against termination to those with more seniority, a much higher percentage of workers covered by collective bargaining agreements seem to enjoy such protection; and (3) The job protection afforded senior nonunion personnel, especially exempt employees, appears to be less strong than that provided to union members.

The direct costs may understate the effects of wrongful termination suits. The fear of such suits could prevent managers from being flexible in adjusting to business cycles, new investment opportunities, or evolving technologies. In response to wrongful termination suits, administrative costs may rise substantially. Costly procedural changes could be balanced by benefits stemming from more efficient utilization of human resources, making everyone better off.

Book excerpt: This paper argues that the structure of long-term employment contractsis influenced by the possibility that at least four different kinds of opportunistic behavior, or "malfeasance,"may occur in them. While the consequences of some of these problems have been examined in various papers,no single model has yet treated all four and thus brought out their essential symmetry. In particular, a certain kind of malfeasance by firms has apparently been universally overlooked-an oversight we try to remedy by developing a simple model here. Other advantages of the present model are that, unlike other models, it endogenizes the path of both sides of the contract -wages and effort -and has fairly intuitive first-order conditions. It also shows how earlier conclusions, such as the notion that wages are likely to rise faster than marginal products in equilibrium, are the results of less-than-general model specification, and has some interesting implications when applied to unionism: by proposing that unions act as workers'equivalent to certain contract enforcement policies like the disciplinary dismissals used by firms, it provides what is to the author's knowledge the only consistent theoretical explanation of the quite commonly observed U-shaped pattern of the union wage effect by age and shows how unions might play a positive efficiency role in this regard.

The proportion of unionized workers is increasing in the services, public sector and among women. Today, almost two out of five union members are employed in the public sector. Wide differences remain in the levels of unionization in diverse countries, while in the United States, France and Spain union members account now for little more than 10% of the labour force, in the Nordic countries (Sweden, Finland and Denmark) the corre'sponding figure is between 75 and 85%. In general, rates have been higher in Europe than in North America. Economic analysis is paying increasing attention to these developments and to their policy implications (Edwards, Caronna and Todling, OCDE 1991). Recent progress in economic theory has enabled some light to be cast on the determinants of unionism, on the other hand, efforts aimed at coming to grips with the economic reality of unions have significantly contributed to theoretical advancement by extending and modifying conventional microeconomic wisdom. The reader of this volume will judge whether the insight gained is sufficient, or - as a recent survey concluded ~ the problem has proved to be virtually intractable (Johnson, p. 24). These can be grouped under three headings, corresponding to the three parts of the volume, which will be illustrated in the Introduction.

The principal conclusions are: (1) Inflation substantially increases the total effective tax rate on the income from capital used in the nonfinancial corporate sector. The total effective tax rate has risen from less than 60 percent in the mid-1960's to more than 70 percent in the late 1970's. (2) The higher effective tax rate reduces the real net rate of return to those who provide investment capital. In the late 19701s, the real net rate of return averaged less than three percent. (3) The interact ion between inflation and existing tax rules contributed to the fall in the ratio of share prices to real pretax earnings, or, equivalently, to the rise in the real cost to the firm of equity capital. (4) By reducing the real net return to investors and by widening the gap between the firms' cost of funds and the maximum return that they can afford to pay, the interaction between tax rates and inflation has depressed the rate of net investment in business fixed capital. (5) The failure to consider correctly the effects of the fiscal structure has caused observers to underestimate the expansionary character of monetary policy in the past two decades. (6) The goal of increasing investment while maintaining price stability can be achieved with tight money, a high real interest rate, and tax incentives for investment. A high real net-of-tax interest rate could reduce residential investment and other forms of consumer spending while the tax incentives offset the monetary effect for investment in business capital.
