Download or read book International Arbitration in Italy written by Massimo V. Benedettelli and published by Kluwer Law International B.V.. This book was released on 2020-12-09 with total page 618 pages. Available in PDF, EPUB and Kindle. Book excerpt: Arbitrating cross-border business disputes has been common practice in Italy since centuries. It is no wonder, then, that Italian arbitration law and jurisprudence are ample and sophisticated. Italian courts have already rendered thousands of judgments addressing complex problems hidden in the regulation of arbitration. Italian jurists have been among the outstanding members of the international arbitration community, starting from when back in 1958, Professor Eugenio Minoli was among the promoters of the New York Convention. Being Italy the third-largest economy in the European Union and the eighth-largest economy by nominal GDP in the world, it also comes as no surprise that Italian companies, and foreign companies with respect to the business they do in the Italian market, are among the main ‘users’ of international arbitration, nor that Italy is part to a network of more than 80 treaties aimed to protect inbound and outbound foreign direct investments and being the ground for investment arbitration cases. Moreover, in recent years, Italy has risen to prominence as a neutral arbitral seat, in particular for the settlement of ‘intra-Mediterranean’ disputes, also thanks to the reputation acquired by the Milan Chamber of Arbitration which has become one of the main European arbitral institutions. This book is the first commentary on international arbitration in Italy ever written in English. It is an indispensable tool for arbitrators, counsel, experts, officers of arbitral institutions and judges who happen to be involved in arbitral proceedings or arbitration-related court proceedings somewhat linked to the Italian legal system, either because Italy is the seat of the arbitration, the Italian jurisdiction has been ousted by a foreign-seated arbitration, the assistance of Italian courts is sought for the granting of interim measures or the enforcement of a foreign award or the arbitration results from a multilateral or bilateral investment protection treaty to which Italy is a party. This book may also be of general interest for scholars and practitioners of international arbitration at large to the extent that it deals with the ‘theory’ of international arbitration and illustrates original solutions offered by Italian arbitration law to various complex issues, such as: the potential conflicts (and required balance) between party autonomy and State sovereignty in the governance of arbitrations; the relationship between the New York Convention and the legal system of the State of the arbitral seat; the potential impact on cross-border arbitrations of insolvencies, human rights, or European Union law; the arbitrability of corporate disputes; the extension of arbitration agreements to ‘necessary parties’. Appendixes include an English translation of the main provisions of Italian law relevant to arbitration, a list of the investment protection treaties to which Italy is a party, and an English version of the Rules of Arbitration of the Milan Chamber of Arbitration. The author, who is full professor of international law, name partner of ArbLit (the first Italian boutique focusing on cross-border dispute settlement) and the current Italian member of the ICC Court of Arbitration, has written the book aiming to combine his academic background with his long-standing experience as counsel and arbitrator.

Download or read book The Italian Utilities Industry written by Andrea Gilardoni and published by Springer Nature. This book was released on 2020-01-21 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses the fundamental changes that the Italian public utilities sector has undergone in the last two decades. Since the late 1990s, liberalisation and privatisation have replaced state-owned monopolies at both the national and local level, new technologies have created a broad range of new opportunities for power generation and distribution, and a redesigned public policy agenda has brought to the fore a whole set of new priorities. In this fast-changing environment, firms have redrawn their strategies, redesigned their business architectures and models, invested in infrastructure and R&D, taken advantage of growth opportunities at home and abroad, opened up their ownership structure, revised their offerings, and developed a new approach to customers. As a result, a radically altered market structure has emerged. As the sector tackles the overriding challenge of sustainability and energy transition, the book takes stock of such past and ongoing developments through the direct testimonies of various stakeholders: the companies in the energy, water, and waste management sectors that are at the forefront of this sweeping transformation; regulators; financial partners; and management consulting firms. The diversity of perspectives and wealth of information presented make this book a valuable resource for anyone wanting to grasp the direction, intensity and causes of change, as well as the nature of the challenges that lie ahead. This work has been prepared as part of the research activities of the Observatory on Alliances and Strategies in the Pan-European Utility Market, one of Agici’s Research and Advisory units.

This book was released on 2009-04-22 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: Damiano Bruno Silipo In the 1990s the Italian banking system underwent profound normative, institutional and structural changes. The Consolidated Law on Banking (1993) and that on Finance (1998) instituted the legal framework for a far-reaching overhaul of the Italian banking and ?nancial system: signi?cant relaxation of entry barriers, the liberalization of branching, the privatization of the Italian banks, and a massive process of mergers and acquisitions. Following the Bank of Italy’s liberalization of branching in 1990, in 10 years the number of bank branches increased by 70% in Italy, while in the rest of Europe it declined. Over the decade the average number of banks doing business in a province rose from 27 to 31, while a wave of mergers (324 operations) and acquisitions (137) revolutionized the Italian banking industry, reducing the overall number of Italian banks by 30%. To a signi?cant extent this concentration represented take-overs of troubled Southern banks by Central and Northern ones. As a result of these developments (plus a rise in banking productivity and a fall in costs), the spread between short-term lending and deposit rates fell from 7 percentage points in 1990 to 4 points in 1999. And despite an increase in concentration in a number of local credit markets, the interest-rate differential between the locally dominant and other banks generally narrowed.

This book was released on 2019-03-27 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: Offering a fresh look at the ways in which neoliberalism has claimed to cure the Balkan region of its ethnic particularities under the pretext of Europeanization, this book shows how the reconfiguration of the economic, political, and cultural landscape of the region has resulted in its functioning as Europe’s neocolony. The contributors to this volume engage in postcolonial analysis of the Balkans’ past and present coloniality by way of interrogating race, racism, trauma, film, and global capitalism. They challenge the idea of a United Europe that rests on the assumption that the European Union’s ‘newness’ represents both a clean slate and the right to shift ownership of its colonial histories to former colonial subjects and their national histories. Taken as a whole, the volume seeks to transform Europe’s colonial amnesia into postcolonial awareness and to speak from within the Balkans as a site of Europe’s neocolony. As it critically interrogates a neocolonial reconfiguration of the Balkans as a massive social overhaul, which includes at once global integration and local social disintegration, this book will be of interest to those studying the region, as well as postcolonialism in general. This book was originally published as a special issue of Interventions: Journal of Postcolonial Studies.
