Book excerpt: Select Products are equity-linked life insurances with investment guarantee in the German market which - in contrast to typical guaranteed equity-linked products - are constructed by using a traditional life insurance contract and suitably leveraging the annual surplus distribution. In this paper, we describe the unique features of traditional life insurance (particularly the collective savings process) and analyze how these features contribute to such products. We present a model framework for the most prominent type of Select Products and compare the product design when offered by a bank or an insurer. Our analysis emphasizes that the current attractiveness of such products arises from the unique features of traditional life insurance by pooling risks as well as the utilization of the balance sheet in the current low interest rate environment. We discuss these aspects in detail and further address benefits as well as detriments of these products depending on the market conditions. We also explain how such products with alternative guarantees interact with an insurer's book of business and can help reduce the risks resulting from “old guarantees”

Until recently, scholars and professionals have approached insurance and investment services as two separate categories in the financial services sector, and as being governed by separate regulatory frameworks. In practice, however, the boundaries were and are blurred, a reality that regulators have begun to recognize and address in their more recent regulatory texts. The first part of the book approaches the new standards applicable to investment products based on insurance: insurance-based investment products (IBIPs). These rules are harmonized across the EU. The rationale behind this new definition is provided, together with a description of these products’ limitations. The analysis addresses the new rules and explores the legal regime and relevant standards applicable to IBIPs. The organizational rules concerning the design and distribution of IBIPs are also examined, and the book highlights e.g. how these rules are inspired by the principles of conduct. In closing, the ADR systems are analysed, in order to ascertain whether or not they can offer an effective tool for settling disputes over these products. In turn, the second part focuses on the liability for distribution of IBIPs, which ranks as one of the most conspicuous and relatively new legal phenomena, but at the same time, represents an exceptionally important field of civil liability in today’s world. Liability is still regulated at the national level. Thus, the four largest life insurance markets in the EU are considered, along with the largest emerging market for life insurance. The chapters on national laws also consider whether, and if so, how the new harmonized rules on IBIPs are being combined with those already in force in the jurisdictions considered. The goal is to determine whether the new rules are likely to change the doctrine and case law approach to these products, or whether the European legislators’ choices have no real impact on the protection of clients.

This dissertation aims to provide insight into the stream of participating life insurances and insurance portfolios. The analysis concentrates on premium sensitivities and adequate adjustments in risk-management strategies - essentially investment allocations and capital requirements - when changing the underlying assumptions. The first three articles analyse insurance products with long-term investment. The first article, "How Sensitive is the Pricing of Lookback and Interest Rate Guarantees when Changing the Modelling Assumptions?", investigates the option-price sensitivity of two common embedded guarantees in unit-linked products - namely, a minimum interest rate and lookback guarantees - when the initial pricing assumptions are uncertain. The analysis showed that lookback guarantees result in a higher risk in respect to changes in volatility parameters, while minimum interest rate are shown to be more sensitive to changes in the interest-rate parameters. The second article, "Is Fair Pricing Possible? An Analysis of Participating Life Insurance Portfolios", focuses on the fair pricing of a portfolio of policies when the default risk is considered. The risk-sharing that arises from the pooling of insurance policies may generate inequalities in the fairness of the premium paid by policyholders of different generations that belong to the same portfolio. The results show that conservative investment strategies, together with important equity contributions, are required to ensure the fair pricing of all generations that take part in the insurance portfolio. Under more risky investment strategies, wealth transfer among generations is unavoidable. They contain an embedded power option, and the key issue is the tractable and realistic hedging of this option, in order to rigorously justify valuation by arbitrage arguments and prevent the guarantees from becoming uncontrollable liabilities to the issuer.
