Book excerpt: The World Bank Group's investment climate project conducted a survey of foreign investors in the Kyrgyz Republic - both those currently operating and those that have terminated their operations for various reasons. The purpose of the survey was to assess selected aspects of the investment policy and legal environment in place in the Kyrgyz Republic, so as to determine whether the current regulations are investment-conducive or otherwise. The following aspects were studied as part of this survey: reasons for selecting a country for investing, ease of market entry, investor confidence, and protection in running a business, investor incentives and market exit. This report presents the analysis of the results of the survey. It consists of six sections, five of which discuss the results of each of the assessed aspects of the investment policy. The sixth section presents some demographics of the survey.

Application of these laws, however, is inconsistent, which can cause problems for and deter foreign investors. In addition, government activities, including constant demands for renegotiation of operating contracts that were legally concluded, invasive and time consuming audits, levying large retroactive fines, and disputes over licenses are impediments to foreign investment.

Book excerpt: This report examines the key challenges faced by small and medium enterprises (SMEs) in the Kyrgyz Republic, in an attempt to identify the issues and areas in most urgent need of reform. The IFC Study of Investment Climate as seen by Small and Medium Enterprises in the Kyrgyz Republic is the first survey of the investment climate in the Kyrgyz Republic conducted by IFC. One of the key objectives of the IFC Study of Investment Climate as seen by Small and Medium Enterprises in the Kyrgyz Republic is to identify precisely those areas in greatest need of reform, in order to reduce the regulatory burden and enable policy makers in the Kyrgyz Republic to establish priorities to encourage new business development and growth, resulting in higher employment and reducing poverty. Data contained in the Survey provide a basis on which the most viable potential reforms might be assessed. The introductory chapter to this report paints a general picture of the macro-economic situation in the Kyrgyz Republic, as well as providing a data-driven description of each of the three categories of enterprises covered in the Survey - individual entrepreneurs, small and medium companies, and farmers. Chapters 3 through 8 provide a detailed examination of Survey findings on a variety of key topics, and each chapter begins with an explanation of the legal and regulatory framework of that issue. Chapter 9 provides an overview of the survey methodology. Finally, the Data Annex presents additional findings on issues covered under Access to Finance and Foreign Trade.

Its trade and investment policies are arguably the most liberal among the member countries of the Commonwealth of Independent States. Despite the generally progressive stance on structural policies and a sound record of macroeconomic management in recent years, economic growth has been modest, living standards are low, a large burden of external debt has accumulated, and integration into global production and trade remains limited. The growth agenda must address more carefully the constraints to greater supply-side response to ongoing reforms--an agenda that can facilitate a broad-based growth of economic activity and exports. Risks to sustainability of current growth rates and continued poverty reduction will otherwise remain high as will the economy's vulnerability to external shocks. This report is aimed at assisting authorities fashioning this agenda by focusing on three key challenges: - Identifying strategic options to strengthen prospects for medium- and long-term growth and poverty reduction; - Assessing ways of leveraging domestic trade policy reforms and existing regional and multilateral trade agreements for further regional and global integration; and - Identifying key areas where greater efforts are necessary to facilitate improvements in enterprise capability and productivity.

Book excerpt: In view of disappointing levels of inward foreign direct investment (FDI), this paper examines capital flows into the Commonwealth of Independent States (CIS) countries and investigates the main impediments to a more favorable investment climate. Direct investment inflows have generally been related to natural resource extraction or energy transportation infrastructure projects, large privatization transactions, and debt/equity swaps to pay for energy supplies. Low FDI inflows despite strengthening macroeconomic performance has reflected a weak investment climate particularly owing to incomplete structural reforms. IMF staff working on the countries concerned cited burdensome tax systems, widespread corruption, extensive state intervention coupled with weak legal and regulatory frameworks, and incomplete structural reforms as the main impediments.

Book excerpt: Private firms are at the forefront of the development process, providing more than 90 percent of jobs, supplying goods and services, and representing a significant source of tax revenues. Their ability to grow, create jobs, and reduce poverty depends critically on a well-functioning investment climate--defined as the policy, legal, and institutional arrangements underpinning the functioning of markets and the level of transaction costs and risks associated with starting, operating, and closing a business. The World Bank Group has provided extensive support to investment climate reforms. This evaluation by the Independent Evaluation Group (IEG) assesses the relevance, effectiveness, and social value of World Bank Group support to investment climate reforms as it relates to concerns for inclusion and shared prosperity. IEG finds that the World Bank Group has supported a comprehensive menu of investment climate reforms and has improved investment climate in countries, as measured by number of laws enacted, streamlining of processes and time, or simple cost savings for private firms. However, the impact on investment, jobs, business formation, and growth is not straightforward. Regulatory reforms need to be designed and implemented with both economic and social costs and benefits in mind; IEG found that, in practice, World Bank Group support focuses predominantly on reducing costs to businesses. In supporting investment climate reforms, the World Bank and the International Finance Corporation use two distinct but complementary business models. Despite the fact that investment climate is the most integrated business unit in the World Bank Group, coordination is mostly informal, relying mainly on personal contacts. IEG recommends that the World Bank Group expand its range of diagnostic tools and integrate them in the areas of the business environment not yet covered by existing tools; develop an approach to identify the social effects of regulatory reforms on all groups expected to be affected by them beyond the business community; and exploit synergies by ensuring that World Bank and IFC staff improve their understanding of each other's work and business models.
