Download or read book Constitutional Reasoning in Latin America and the Caribbean written by Johanna Fröhlich and published by Bloomsbury Publishing. This book was released on 2024-09-05 with total page 615 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the reasoning practice of 15 constitutional courts and supreme courts, including the Caribbean Commonwealth and the Inter-American Court of Human Rights. Enriched by empirical data, with which it strives to contribute to a constructive and well-informed debate, the volume analyses how Latin American courts justify their decisions. Based on original data and a region-specific methodology, the book provides a systematic analysis utilising more than 600 leading cases. It shows which interpretive methods and concepts are most favoured by Latin American courts, and which courts were the most prolific in their reasoning activities. The volume traces the features of judicial dialogue on a regional and sub-regional level and enables the evaluation and comparison of each country's reasoning culture in different epochs. The collection includes several graphs to visualise the changes and tendencies of the reasoning practices throughout time in the region, based on information gathered from the dataset. To better understand the current functioning and the future tendencies of courts in Latin America and the Caribbean, the volume illuminates how constitutional and supreme courts have actually been making their decisions in the selected landmark cases, which could also contribute to future successful litigation strategies for both national constitutional courts and the Inter-American Court for Human Rights. This project was made possible due to the collaboration and funding provided by the Rule of Law Programme for Latin America of the Konrad Adenauer Foundation and the Law School of the University of San Francisco de Quito.

This book was released on 2023-09-29 with total page 1420 pages. Available in PDF, EPUB and Kindle. Book excerpt: The human rights movement strives to develop a universal culture of human rights in all societies, as well as to confront gross violations. This book, the first ever of its kind, is a veritable State of the World Report on Human Rights. It reproduces summaries by UN High Commissioners for Human Rights on the state of the national human rights protection systems of each UN Member State. These summaries were sent following each state’s passage through the Universal Periodic Review (UPR) process of the UN Human Rights Council. The summaries identify each state’s constitutional, legal, judicial and institutional architecture, international conventions not yet ratified, areas of progress, problem areas, and problems affecting different parts of the population. The High Commissioners’ summaries reproduced here are preceded by insightful reflections on the concept of a national human rights protection system, and by regional outlines of national human rights protection systems in the Americas and the Caribbean, Europe Africa, Asia and the Pacific. The book also contains some case studies of the national human rights protection systems of sample states such as Australia, Bhutan, Brazil, Canada, Democratic Republic of the Congo, Guyana, Portugal, Switzerland, Sweden, and South Africa.
Download or read book The Inter American System as a Tool for Ensuring Access to Pain Relief and Palliative Care written by Guarnizo Peralta, Diana and published by Djusticia. This book was released on 2018-03-30 with total page 35 pages. Available in PDF, EPUB and Kindle. Book excerpt: Through the financial support from the Open Society Foundations, Dejusticia developed a diagnostic research from eight countries, Argentina, Chile, Colombia, Costa Rica, El Salvador, Guatemala, Panama and Uruguay, regarding the access to palliative care, the institutional development and the guidelines, and the existing barriers of access to opioid medications – used for pain relief. This document is aimed at medical personnel, civil society organizations, policy makers, and any¬one interested in addressing the issue of palliative care from a human rights perspective. Although for years palliative care was confined to a strictly medical analysis, in recent times the international community and United Nations bodies have recognized palliative care as a human rights issue. This document seeks to demonstrate the many linkages between palliative care and human rights in terms of both the conception and the protection of palliative care. We hope this report serves as a useful tool for the medical community, patients, and patients’ fam¬ilies throughout the American continent who seek legal and human rights arguments to facilitate access to more humane end-of-life care, as well as for litigants and human rights activists who wish to protect and guarantee a life without pain for patients, including during their last days of life.
