Por una parte, se intenta mostrar que las normas e instituciones se basan en épocas y contextos específicos que determinan su fisonomía, que se construyen en la interacción de los actores del sistema de justicia y que se encuentran conectadas con la normativa internacional. Por otra parte, se trata de temas que tradicionalmente no son tratados en los manuales y que se basan en los principios fundamentales. Se revisan, por ejemplo, los efectos de la ley procesal en el tiempo y en el espacio, la estructura orgánica de los tribunales, incorporando nuevas perspectivas de análisis. Se incluye, también, una amplia sección sobre mecanismos ADR (Resolución Alternativa de Disputas), temática que ha tenido un enorme crecimiento normativo y de aplicación en nuestro medio. Asimismo, se trata en un capítulo completo el examen del derecho al debido proceso, el intercambio de los tribunales internacionales, la búsqueda de una visión completa y actualizada sobre uno de los pilares acerca de los principios actuales de los sistemas procesales. Se integran también las políticas públicas, las reformas procesales, y se ofrece una visión sistémica del proceso judicial con el fin de ampliar y enriquecer su examen más allá del mero análisis normativo. Por último, esta obra está pensada para y, de algún modo, por estudiantes. Decimos “para” estudiantes, pues se trata de un texto que se usa en varias ocasiones para asegurar la comprensión mediante el uso de esquemas o mapas conceptuales, referencias a casos reales, además de contar al final de cada capítulo con un conjunto de preguntas, casos hipotéticos y análisis de jurisprudencia. Pero también es un texto pensado "por" estudiantes, pues las versiones preliminares fueron utilizadas en nuestros cursos como material de lectura obligatoria. Ello nos ha permitido testear su aplicación y resultados.
