Available in PDF, EPUB and Kindle. Book excerpt: to Seeking the answer to the three basic questions of contempo rary private international law, I also deemed it essential to out line to the reader the historical development of the different concepts of this particular branch of law, for without the know ledge of this history it is impossible to understand the contempo rary problems. The fact that private international law oscillates between public international law and substantive municipal law as it is applied in individual countries creates considerable problems in both theory and practice. I have tried to deal with these problems in the third part of my study, concerning "universa lism" and "nationalism" in the doctrine of private international law, as well as in its fourth part, which is devoted to the object and nature of this law and its place in the overall system of law. The character of private international law, ensuing from the plurality of municipal laws - which also characterize the origin and existence of comparative jurisprudence - in spired me to produce the fifth part of this study, which prima rily tries to expJain the theoretical problems of comparative jurisprudence but does so - defining its objectives and possibili ties - in order to underline at the same time its role in private international law and in the law of international trade.

Book Dealing with Bribery and Corruption in International Commercial Arbitration

Download or read book Dealing with Bribery and Corruption in International Commercial Arbitration written by Emmanuel Obiora Igbokwe and published by Kluwer Law International B.V.. This book was released on 2023-01-10 with total page 455 pages. Available in PDF, EPUB and Kindle. Book excerpt: International Arbitration Law Library, Volume 65 International commercial arbitration is by no means free from bribery and corruption. Although a plethora of legal scholarship clearly affirms this contention, a thorough study on the particularly important question of the authority and duty of international commercial arbitrators to investigate a suspicion or indication of bribery or corruption sua sponte ¬– that is, on their own initiative – has been surprisingly lacking. This important book fills this gap, inter alia, by locating sua sponte authority in the position of arbitral tribunals in establishing the facts of a case and ascertaining and applying the applicable normative standards. In addition to providing a comprehensive examination of how the issue of bribery and corruption is dealt with in contemporary international commercial arbitration, the book also highlights the role of arbitrators in global efforts to combat transnational commercial bribery and corruption. Among others, the following critical issues are thoroughly investigated: arbitrability of issues of public interests; intermediary contracts; role of arbitrators in the fact-finding process; party autonomy versus overriding mandatory rules; iura novit curia in international commercial arbitration in the context of bribery and corruption; notion of transnational (or ‘truly international’) public policy; arbitrators’ duty to act as guardians of international commerce; investigative tools available to arbitrators; dealing with manifestly recalcitrant parties; possible consequences of violating the obligation to sua sponte investigate; and the view from developing countries. The analysis leans primarily on Swiss law, as Switzerland is one of the most important jurisdictions in international commercial arbitration; Switzerland has also been involved in some of the most famous and controversial arbitration cases wherein bribery and corruption became an issue. However, the study also includes a comparative analysis of the relevant laws, jurisprudence, and doctrine of other major arbitration venues, particularly England, France, and Germany. Not only in the light it sheds on how and whether international commercial arbitrators have hitherto justified the trust States have placed in them regarding the protection of the public interests but also in the practical solutions it offers arbitrators faced with issues of bribery and corruption, this deeply researched book equips arbitration practitioners and arbitration institutions with a hitherto lacking in-depth analysis on the question of sua sponte investigation. It also provides invaluable insights on how this issue might affect the future, legitimacy and expansion of this dispute settlement mechanism. Outside the field of arbitration, the book also provides jurists, legal scholars, in-house counsel for companies doing transnational business and public officials with highly enlightening perspectives on the interaction between international commercial arbitration and public interests.

This book was released on 1987-04-14 with total page 436 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sovereign Equality of States in International Law, R.P. Anand R.P. Anand, Professor at the Jawaharlal University of New Delhi, points out in the introduction of his course that the principle of sovereign equality of States refers to two twin principles which are accepted as unimpeachable norms of modern international law which cannot be questioned: the principles of equality and of sovereignty of States. Taking this as his starting point, the author first discusses the sovereignty of States in an interdependent world. He then examines the principle of equality of States in an unequal world from a historical perspective. Finally, Professor Anand tackles the questions of equality of States in a hierarchical world order, and mini-States and equality of rights. La Méthode de la Référence à l'Ordre juridique compétent en Droit international privé, Paolo Picone Paolo Picone, Professor at the University of Naples, notes in the introduction to his course that contemporary international law, such as it evolved during the 19th century, developed different methods of coordination. One method has nevertheless been neglected, which consist in choosing not the applicable law, but the competent legal system. After discussing the crisis in private international law, the author examines the method of coordination of legal systems based on the applicable law, followed by one that is based on reference to the @@@competent legal system. @@@He describes the functioning of the latter method in the case of the creation of legal situations in the @@@for, and in the case of recognition of foreign legal situations in the for. Professor Picone finishes his course by investigating the use of this method in solving the problem of preliminary matters in private international law, the method's area of application and its future prospects.

Book Set off Defences in International Commercial Arbitration

Download or read book Set off Defences in International Commercial Arbitration written by Christiana Fountoulakis and published by Bloomsbury Publishing. This book was released on 2010-12-22 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book deals with set-off in international arbitration proceedings. In these proceedings, set-off is frequently the tool relied upon to resist a claim. At the same time, the legal intricacies make it hard to use. The first part of the book provides a survey of set-off, including its definition, significance and functions. The second part offers a thorough comparative analysis of selected European laws of set-off and reveals the dramatic differences between them. The third and last part of the book deals with the problematic consequences of these differences and shows the limits and the inadequacy of the traditional choice-of-law doctrines. While demonstrating how to overcome the practical hurdles of the present situation, the third part also offers normative alternatives that should provide significant help in the adjudication of commercial disputes. This title is included in Bloomsbury Professional's International Arbitration online service.
