Book Failures and the Law

Download or read book Failures and the Law written by H.P. Rossmanith and published by Routledge. This book was released on 2003-09-02 with total page 584 pages. Available in PDF, EPUB and Kindle. Book excerpt: The interaction between engineering and the law is undergoing dramatic changes. Product liability, laws have been introduced in Japan, patent claims over living organisms have been made in bioengineering and the differing national laws of copyright protection and liability are in the process of harmonisation, especially in the European Union. The pace and complexity of these changes make it essential for technologists, lawyers, engineers and insurance experts to establish a common basis for understanding, co-operation and exchange of expertise. The recently founded International Society for Technology, Law and Insurance aims to foster such co-operation. This volume features 46 selected contributions which address various topical issues and the law. The most important issues relate to engineering risks, quality assurance and assessment and legal implications assiciated with them. Recent failure cases are explained and the technical, legal and insurance-related issues discussed in detail.

Book Risk and Insurance in Construction

Download or read book Risk and Insurance in Construction written by Nael G. Bunni and published by Routledge. This book was released on 2022-02-16 with total page 705 pages. Available in PDF, EPUB and Kindle. Book excerpt: The new 3rd edition of Nael Bunni’s Risk and Insurance in Construction, now co-authored with Lydia Bunni, explains the need for insurance in construction and engineering projects and why it must be incorporated into the Conditions of Contract for such projects. It is unique in bringing together the background of the two topics of 'risk' and 'construction insurance', explaining the flow and the interaction between them and then dealing with how they have been used to formulate the 2017 FIDIC Suite of Contracts and the 2021 Green Book. This edition has been fully updated, and new chapters deal with the latest definitions of 'risk' outlined in ISO 31000: 2009, and specifically explains the principles embodied in the new Clauses 17, 18 and 19 of the Major Suite of the FIDIC forms of contract and how they should be used. An important chapter (Chapter 5) is included, discussing the logical transition from decision-making to risk identification to responsibility for those allocated with particular risks, to the potential liability that results. This includes discussing particular liabilities that may arise for parties typically involved in construction and engineering projects, including developers, owners, contractors and designers. This part of the book links insurance to the law and explains the interaction between the two topics. The correlation between liability and the need for indemnity, which can only be provided properly through insurance, is highlighted. The book is essential reading for practitioners from both the engineering profession and the insurance industry in all types of projects. Engineers who are required to use one of the Major Forms of the FIDIC Suite of Contracts, whether they are designers or contractors, and those involved in the insurance sector, whether brokers, claim consultants or insurance company personnel, will find this book to be an indispensable reference.

Book Practice Management for Design Professionals

Download or read book Practice Management for Design Professionals written by John Philip Bachner and published by John Wiley & Sons. This book was released on 1991-09-03 with total page 406 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the mid-1960s geotechnical engineers paid the highest liability insurance of any profession and by 1969 were virtually uninsurable. As a result, the ASFE was founded and helped these engineers not only lower their insurance rates, but get to the point where, by 1980, they were the least liability-prone members of the design profession. Now, John Bachner and the ASFE tell all other design professionals how to accomplish the same task. This book, which incorporates the ASFE's Introduction to Professional Practice program for advancing architects' and engineers' knowledge of professional practice issues, addresses almost every aspect of the design professionals' practice as they relate to liability, from procedures for verifying the accuracy of technical output to steps for improving client and project selection, workscope development, personnel training and dispute resolution.

Book Architect and Engineer Liability

Download or read book Architect and Engineer Liability written by Kevin Sido and published by Aspen Publishers. This book was released on 2020-09-21 with total page 1968 pages. Available in PDF, EPUB and Kindle. Book excerpt: Architect and Engineer Liability: Claims Against Design Professionals, Fifth Edition, details all relevant topics relating to liability claims: risk management, alternative dispute resolution, trial conduct, handling shop drawings, insurance and surety, and more. Prepared for design and construction professionals and their attorneys, this comprehensive, up-to-date resource is written by eminent authorities in the field and provides straightforward answers to all your legal questions, as well as examples of the valuable lessons learned by leading design and construction experts. The Fifth Edition adds significant new and revised material on a number of critical topics, as well as expanded discussion and analyses of the latest court decisions, trends, and issues in the rapidly evolving area of construction law, including the following: Explanation for the American Institute of Architect's (AIA's new and revised forms: Construction Manager as Adviser (B132(TM)-2019); Construction Manager as Constructor (B133(TM)-2019); and Standard Form Multi-Party Agreement for Integrated Project Delivery (AIA C191-2019). Which of an architect's commercial general liability policies apply is dependent upon whether there is damage during the respective policy period. And if there is damage over several policy periods, the issue becomes whether the limits and the self-insured retentions/deductibles "stack." Whether an engineer was protected by the application of the economic loss doctrine can be determined by whether the owner's damage claims were economic losses. The New Hampshire Supreme Court in 2019 held that indemnity and contribution claims against a design professional could be barred by the New Hampshire statute of repose as purely economic losses. The 2019 AIA updates to the Construction Manager as Constructor (CMc) documents include a new standard of care that requires the construction manager to "exercise reasonable care in performing its Preconstruction Services"; and contain insurance requirements for the CMc during the preconstruction phase that match the insurance requirements for the architect. Effective August 1, 2019, a North Carolina law provides critical protections for design professionals when faced with the question of whether they owed a duty to defend the owner of a project. A New York City mayor's discretionary conduct in refusing to take the steps necessary to authorize a construction project (i.e., inaction) was shielded by legislative immunity. A provision of the standard form A201 General Conditions incorporated into a contract further defined the term "architect" to include the authorized representatives of the listed architect in the contract which permitted a principal, as a representative of the architectural firm, among those persons able to demand arbitration under the terms of the contract. Under Indiana law, construction managers owe a duty for job-site employee safety in two circumstances: when the construction manager has contractually assumed a duty for job-site safety or when the construction manager voluntarily assumed a duty for job-site safety.
