As it has developed into an independent branch of Translation Studies, this book advocates for a substantiated discussion of methods and methodology, as well as knowledge about the variety of approaches actually applied in the field. It is argued that, complex and multifaceted as it is, legal translation calls for research that might cross boundaries across research approaches and disciplines in order to shed light on the many facets of this social practice. The volume addresses the challenge of methodological consolidation, triangulation and refinement. The work presents examples of the variety of theoretical approaches which have been developed in the discipline and of the methodological sophistication which is currently being called for. Unfortunately, over-reliance on such outsourcing has given rise to significant dangers, including information asymmetry, goal divergence, and risk. Legal Translation Outsourced provides the only current reference on commercial legal translation performed outside institutions. Juliette Scott casts a critical eye on the practice as it now stands, offering an analysis of key risks and constraints. Her work is informed by empirical data of the legal translation outsourcing markets of 41 countries. Scott proposes original theoretical models aimed both at training legal translators and informing all stakeholders, including principals and agents. These include models of legal translation performance; a classification of constraints on legal translation applying upstream, during and downstream of translation work; and a description of the complex chain of supply. Working to improve the enterprise itself, Scott shows how implementing a comprehensive legal translation brief--a sorely needed template--can significantly benefit clients by increasing the fitness of translated texts. Further, she opens a number of avenues for future research with an eye to translator empowerment and professionalization.

Choi identifies different agents and procedures involved in institutional translation practices, discusses linguistic and genre features of translations, and investigates changes made in translations compared to the original documents, during the two Korean presidencies of Lee Myung-bak (2008–2013) and Park Geun-hye (2013–2017). Choi’s book explores important facets of Korean government translation in the belief that practices associated with the normative meaning and concept of government translation have to be displaced into the wider understanding of the concept of translation as a social construct. Drawing on the theoretical frameworks of institutional translation and critical discourse analysis–informed corpus-based translation studies, the chapters discuss the practice, process and products of Korean government translation. The Korean–English parallel corpus methodology used introduces a systemic way to analyse changes in Korean government translations, based on a personally built sentence-level tagged corpus, both qualitatively and quantitatively.
