Book excerpt: The post of Information Commissioner is one of those identified as eligible for pre-appointment hearings by the Justice Committee. The current Commissioner, Richard Thomas, is due to step down in June 2009 after five years in post, and the preferred candidate to succeed him is Christopher Graham, Director General of the Advertising Standards Authority. The Committee was invited by the Ministry of Justice to report on Mr Graham's suitability for the role, which is to be extended by provisions in the Coroners and Justice Bill going through Parliament. Mr Graham's background clearly provides him with a range of experience indicative of his suitability to be a candidate for the role of Information Commissioner, including familiarity with the regulatory landscape, the development of codes of practice, the potential for judicial review, customer service, assessing compliance, running a large organisation and managing change. In view of the overall challenge facing a new Information Commissioner - an increase of an order of magnitude on what Mr Graham has previously dealt with - the Committee welcomed the opportunity to question him on his view of the priorities and potential approach. The Committee believes the Government should ensure the Commissioner has sufficient resources for its work. The Committee endorses Mr Graham's suitability for appointment as Information Commissioner and his preliminary view of the priorities of the role and its supporting organisation. It looks forward to a continuing dialogue on progress both in protecting people's personal information effectively and sensitively, and in securing implementation of the letter, and the spirit, of the Freedom of Information Act.

Book excerpt: The Freedom of Information (FOI) Act and the new Environmental Information Regulations came into force fully on 1 January 2005. They give people the right of access to information held by over 100,000 public authorities across the UK. This inquiry examines the first year's experience of FOI and considers the impact which it has made. The implementation of the FOI Act has already brought about the release of significant new information. The Committee is impressed by the efforts made by public authorities to meet the demands of the Act. The most commonly cited problem for requesters was delays in responding to requests. Published data show that there are many cases where the 20 day statutory response time is not being complied with, and lack of interpretation in the code of practice as to 'reasonable' time limits enables public authorities to make indefinite extensions of many months. The report identifies a number of areas where the Department for Constitutional Affairs (DCA) should improve compliance, the immediate priority being a more assertive enforcement of the law. The complaints resolution process provided by the Information Commissioner's Office during 2005 was unsatisfactory, with many delays in starting investigation of complaints, and concerns over the standard of investigation and information provided in the decisions. The Committee welcomes the Commissioner's proposals to increase efficiency and effectiveness, and would like the Commissioner to be directly responsible to, and funded by, Parliament. Another area of concern is the long-term preservation of electronic records. Records management practices in some public authorities need substantial improvement. Plans are needed to handle the rapid and significant changes in technology and the inevitable degradation of storage media. Freedom of Information has no force without a proper commitment to ensure that the information held is in a retrievable form.

Book excerpt: From the early 2000s, a new discourse emerged, in Africa and the international donor community, that higher education was important for development in Africa. Within this zeitgeist of converging interests, a range of agencies agreed that a different, collaborative approach to linking higher education to development was necessary. This led to the establishment of the Higher Education Research and Advocacy Network in Africa (Herana) to concentrate on research and advocacy about the possible role and contribution of universities to development in Africa. This book is the final publication to emerge from the Herana project. The project has also published more than 100 articles, chapters, reports, manuals and datasets, and many presentations have been delivered to share insights gained from the work done by Herana. Given its prolific dissemination, it seems reasonable to ask whether this fourth and final publication will offer the reader anything new. This book is certainly different from previous publications in several respects. First, it is the only book to include an analysis of eight African universities based on the full 15 years of empirical data collected by the project. Second, previous books and reports were published mid-project. This book has benefited from an extended gestation period allowing the authors and contributors to reflect on the project without the distractions associated with managing and participating in a large-scale project. For the first time, some of those who have been involved in Herana since its inception have had the opportunity to at least make an attempt to see part of the wood for the trees. Different does not necessarily mean new. An emphasis on the newness of the data and perspectives presented in this book is important because it shows that it is more than a historical record of a donor-funded project. Rather, each chapter in this book brings, to a lesser or greater extent, something new to our understanding of universities, research and development in Africa.
