Download or read book Wounded Justice And The Story Of Indian Police written by James Vadackumchery and published by Kaveri Books. This book was released on 2003-12 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Indian Police Act Came Into Existence In 1861. The Objectives Of The Act, Through Spelt Out Clearly In The Act, Are At Best Suspicious. For, The Law Was Enacted More For The Maintenance Of The British Domain In India Via Police Than Administration Of Fair Justice To The People. For, Wounded Justice Administration Has Been In Existence Ever Since The Indian Police Act - 1861 Came Into Force. Every Now And Then, Criticisms Are Levelled Against The Police And Against Police Strategies. Crimes Have Been Constantly Onthe Increase And Conviction Rate On The Decrease. The Story Of Indian Police Is A Story Of Wounded Justice Administration And It Can Be Injustice Or Miscarriage Of Justice (?) Police Became Unpopular With The Public And Popular With The Vested Interest. Justice Meant Goodness, Reighteousness And Truth For The British, But It Was Not So For Them For Indians. For, The British Never Wanted It To Be So In India. When India Became Independent, The British Left The Country And Democracy Was Established. In Indian Democracy, The Political Parties Which Came Into Power From Time To Time Ruled The Police Just Like The British Did Here. They Too Wanted To Maintain Their Domain Through The Police. In Order To Please The Government In Power, The Police Resorted To Everything And Ultimately, It Has Been Observed That The Police Failed To Administer Proper Justice To The People. Just Like The White Men Occupied Important Positions In Police During The Colonial Rule, Officers Who Are The Yes Man Of The Political Party In Power Occupied Strategic Posts After India Became Indepedent. Now, There Is A Move To Divorce The Police From Political Inteference As The Nexus Between The Political Parties And The Police Often Becomes A Powerful Cause For Administration Of Wounded Justice. Chapter 1: Introduction, Chapter 2: Wounded Justice And Police Under The British, Chapter 3: Wounded Justice: The Police Legacy Or People S Curse?, Chapter 4: Wounded Justice: The Police Pragmatism Or People S Fatalism?, Chapter 5: Wounded Justice: The Police Instincts And The People S Expectations, Chapter 6: Wounded Justice: An Age Old Evil And Public Reaction, Chapter 7: Wounded Justice: Police Commission And Politicians, Chapter 8: Wounded Justice: National Police Commission-Before And After, Chapter 9: Wounded Justice: Philosophies And Principles, Chapter 10: Wounded Justice And Committee On Police Reforms: Looking Ahead.

Book excerpt: Policing The Police May Be A Strange Concept For The Police - But Is Necessary To Police The Society In Indian Democracy Today. Policing The Police With People S Participation Is A New Concept Of Recent Origin And The Book Deals With The Lack Of Policing In Police Down The Centuries. The British Created An Oppressive And Repressive Police To Retain Their Imperialism. The Police Committed Crimes With Abandon And The British Legacy Continued Even After India Became Independent. The Politicians Exploited The Police And Abused Police Muscles To Achieve Political Advantages For Them. The Police Misused Their Power And Authority To Serve Their Self Interests. Owing To The Lack Of Policing With The Police, People Developed A Negative, Avoiding And Hostile Attitude To Police Service. The Antiquated Police Act-1861 Did Not Envisage Any Healthy Human Contact Between The Police And The Citizenry. The Same Situation Continues Even After 50 Long Years To Policing The Democracy. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the procedural, cultural, and institutional framework of custodial interrogation in India. It explores theoretical and practical perspectives on custodial interrogation practices in India which have been in urgent need for reform and critiques the systemic failure on the part of the police in India to implement suspects’ rights uniformly. This volume, — Analyses the Indian framework of custodial interrogation to identify its fundamental flaws, and emphasises on the need for having a lawyer present during custodial interrogation; — Demonstrates significant evidence on state of suspects’ rights in India through comparative law methodologies with a focus on common law scholarship and jurisprudence, more particularly England and Wales, and supplemented by vital empirical research through key interviews with related institutional parties; — Discusses emerging, seminal jurisprudence of the European Court of Human Rights on applications of the right to fair trial at the custodial interrogation stage, especially shedding light on modern applications of the right to legal assistance in England and Wales, and radical Strasbourg-inspired reforms in other European jurisdictions; — Highlights the right to legal assistance as one of the viable solutions to break the culture of police lawlessness at this critical stage of the criminal process. An invigorating study, this book is aimed at enriching data and hypothesis for academics, policy makers, civil society organizations, and students working in the area of law and legal studies, police and policing, citizenship, and political science.

It draws on in-depth investigations into 17 deaths in custody that occurred between 2009 and 2015, including more than 70 interviews with victims' family members, witnesses, justice experts, and police officials. In each of the 17 cases, the police did not follow proper arrest procedures, making the suspect more vulnerable to abuse"--Publisher's description.
