Book excerpt: An epic true story of greed, power and a desire for legacy from an acclaimed Australian storyteller. July 2014, a lonely road at twilight outside Croppa Creek, New South Wales: 80-year-old farmer Ian Turnbull takes out a .22 and shoots environmental officer Glen Turner in the back. On one side, a farmer hoping to secure his family’s wealth on the richest agricultural soil in the country. On the other, his obsession: the government man trying to apply environmental laws. The brutal killing of Glen Turner splits open the story of our place on this land. Is our time on this soil a tale of tragedy or triumph – are we reaping what we’ve sown? Do we owe protection to the land, or does it owe us a living? And what happens when, in pursuit of an inheritance for his family, a man creates terrible consequences? Kate Holden brings her discerning eye to a gripping tale of law, land and entitlement. It is the story of Australia. ‘An incredible writer.’ —Books+Publishing ‘Kate Holden finds the epic thread in this crime and weaves a quintessential Australian story.’ —Chloe Hooper ‘Beautifully written, meticulously researched, carefully plotted and seamlessly stitched together. This book is a major contribution to the canon of Australian land and social history: a bedfellow with Francis Ratcliffe, W.E.H. Stanner, Tim Flannery, Bill Gammage and Bruce Pascoe ... Its power is in exposing a hidden, suppurating sore in the psyche of our nation.’ —Charles Massy, author of Call of the Reed Warbler ‘A gripping account of our land, and our selves.’ —Tara June Winch ‘I felt utterly in the grip of this agonising and powerful parable. Kate Holden brilliantly telescopes centuries of history and law into fatal conversations at a farm gate. As one man stalks another on a winter road, the whole psyche of modern Australian settlement comes under trial. An enthralling and disturbing tale told with deep insight and compassion.’ —Tom Griffiths ‘Beautifully and compellingly told, shattering in its reverberations, The Winter Road is a story for our times – a battle that is being fought the world over as we try to find a better way of managing the land and respecting the forces of nature that sustain us.’ —Isabella Tree ‘This is a special book, and I cannot thank Holden enough for writing it. By telling the human story of a man and his land, Holden reveals the timelessness of brigalow country, and threads a narrative that is ecological, humane and grounding.’ —Anna Krien

This book was released on 1998-01-01 with total page 59 pages. Available in PDF, EPUB and Kindle. Book excerpt: Biodiversity-related laws and institutions will be key mechanisms for attaining the objectives of the Convention on biological diversity. As part of the national biodiversity planning process, legal and institutional profiles should be undertaken to ascertain which laws apply to and affect biodiversity and which institutions oversee legislation and portfolios which intersect with biodiversity conservation, sustainable use and benefit-sharing of genetic resources. Drawing on lessons learned in Bangladesh, Cuba and the Gambia, this will provide legal practitioners with background information and a suggested analytical road map for reviewing their country's particular legal and institutional situation.

Chapters present many widely recognised issues involved in Australia’s land use policy and planning, including limited understanding and poor awareness of: the rich history of poor decisions on land use planning and management across different levels of governmentthe discontinuities between providers of national biophysical informationthe tools, data and information to improve national land use decision-making outcomesthe poor synthesis and integration between science to policy to natural resource management and resource conditionthe benefits of land use practitioners engaging in connection, cooperation, mutual inquiry and collective social learnings. The aims of the book are threefold: 1) provide a review of the current status of land use policy and planning in Australia; 2) provide a resource to inform and influence the development of land use policy and planning; and 3) provide a sound contribution to Australia’s public–private land use debates in the future. The audience for the book includes government and non-government land management agencies from state and national bodies, universities and researchers.

Book Biodiversity Litigation

  • Author : Guillaume Futhazar

Download or read book Biodiversity Litigation written by Guillaume Futhazar and published by Oxford University Press. This book was released on 2023-03-29 with total page 449 pages. Available in PDF, EPUB and Kindle. Book excerpt: Biodiversity is in accelerated decline and urgent action is needed. In 2020, the Strategic Plan for Biodiversity ended, and none of its Aichi Targets were met. Despite the legally disappointing situation on a global level, the role of national courts in adjudicating climate change litigation is showing potential for effective mitigation and adaptation, and judges have become key actors in linking internationally agreed goals with tangible national commitments to mitigate climate change. Can this pursuit of globally agreed goals at a local level be transposed and lead a similar trend for biodiversity governance? This edited collection gives readers an overview of the shape and reach of biodiversity litigation, drawing on specific case studies from countries such as Brazil, China, India and Canada. It considers two questions: Firstly, what is the influence of international biodiversity law on biodiversity litigation? Secondly, what are the trends of biodiversity litigation? Leading experts discuss these questions from the perspective of developing, developed and mega bio-diverse countries, promoting the concept of biodiversity litigation as a common notion of environmental law, and arguing for more creative legal thinking when dealing with and analysing biodiversity-related disputes.

Book The Constitution of the Environmental Emergency

Download or read book The Constitution of the Environmental Emergency written by Jocelyn Stacey and published by Bloomsbury Publishing. This book was released on 2018-04-19 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book argues for a reframing of environmental law. It starts from the premise that all environmental issues confront lawmakers as emergencies. Environmental issues pose a fundamental challenge to law because it is impossible to reliably predict which issues contain the possibility of an emergency and what to do in response to such an unforeseen event. These features undermine the conventional understanding of the rule of law. This book argues that approaching environmental issues from the emergency perspective leads us to an understanding of the rule of law that requires public justification. This requirement recentres the debates in environmental law around the question of why governance under the rule of law is something worth having in the environmental context. It elaborates what the rule of law requires of decision-makers in light of our ever-present vulnerability to catastrophic environmental harm. Controversial, compelling and above all timely, this book presents an important new perspective on environmental law.

Book Murray Darling Basin Australia

Download or read book Murray Darling Basin Australia written by Barry Hart and published by Elsevier. This book was released on 2020-10-23 with total page 470 pages. Available in PDF, EPUB and Kindle. Book excerpt: Murray-Darling Basin, Australia: Its Future Management is a much-needed text for water resources managers, water, catchment, estuarine and coastal scientists, and aquatic ecologists. The book first provides a summary of the Murray-Darling River system: its hydrology, water-related ecological assets, land uses (particularly irrigation), and its rural and regional communities; and management within the Basin, including catchments and natural resources, water resources, irrigation, environment, and monitoring and evaluation. Additionally, the recent major water reforms in the Basin are discussed, with a focus particularly on the development and implementation of the Basin Plan. Murray-Darling Basin, Australia: Its Future Management then provides an analysis of the next set of policy and institutional reforms (environmental, social, cultural and economic) needed to ensure the Basin is managed as an integrated system (including its water resources, catchment and estuary) capable of adapting to future changes. Six major challenges facing the Basin are identified and discussed, particularly within the context of predicted changes to the climate leading to an increased frequency of drought and a hotter and dryer future. Finally, a ‘road map’ or ‘blueprint’ to achieve more integrated management of the Basin is provided, together with some ‘key lessons’ of relevance to others involved in the management of multijurisdictional river Basins. Provides a consolidated account of the Murray-Darling Basin system; an area of global relevance to those interested in rebalancing river systems where the water resources have been over allocated Offers a detailed analysis of the current system and its management, with a focus on water and ecosystem management Discusses a number of key challenges, particularly those related to climate change, facing future reforms to the Murray-Darling Basin Plan Provides a blueprint for changes needed to ensure the Basin is managed as an integrated whole (from catchment to coast)
