Book excerpt: Multilateral development banks and other development agencies have adopted environmental and social safeguard policies setting due diligence standards for the provision of project finance. Such policies are evolving in terms of the activities covered and in their normative requirements. Recent iterations incorporate human rights requirements, recognising the imperative of adopting human rights-based approaches to development. Each institution has also established independent accountability mechanisms (IAM), variously functioning to ensure compliance with the applicable safeguards, to advise management regarding the application of the obligations involved, and to facilitate communication with affected communities and individuals with a view to resolving project-related disputes. IAMs are central to the implementation, interpretation, and ongoing elaboration of safeguard policies, and thus to the environmental and social good governance so essential for sustainable development. This edited volume presents a series of in-depth examinations by leading experts from banking institutions, academia and civil society, of key aspects of the rapidly evolving practice of IAMs, and of the implications of such practice for environmental and social governance.

A classic question has become whether agencies can be held to account if they are independent. This paper argues that discussing independent agencies through this dilemma leads to certain misperceptions. Firstly, independent agencies are not independent. Secondly, they can be accountable, and if they are not, this is not simply caused by agencies' independence. This paper calls for an appropriate definition to nuance the expectation one could have from the term 'independent' and points out several directions for future academic consideration on the accountability of 'independent' agencies. It uses a comparative legal approach and focuses on US and EU independent agencies to exemplify the mentioned issues.

Book excerpt: Independence and accountability...accountability and independence...these have become two 'usual suspects' when talking about independent regulatory agencies (IRAs), the classic question being whether IRAs can be accountable, if they enjoy independence. While in recent years it has been more often argued that these notions are mutually complementary, this article proves the negative correlation between accountability and independence. It shows that the more independence there is, the less accountability channels and accountability instruments are left, and the other way around. It does so by bringing conceptual clarity into the concept of independence showing that independence, and more specifically its three elements (institutional, personal and financial), is the means to protect functional discretion, i.e., a possibility to make substantive and/or procedural choices. While functional discretion and accountability can and should co-exist, independence and accountability can exist only at each other's costs.

The inability of philosophy to answer this question in a compelling manner—along with the moral skepticism and ethical confusion that ensue—result, Stephen Darwall argues, from our failure to appreciate the essentially interpersonal character of moral obligation. After showing how attempts to vindicate morality have tended to change the subject—falling back on non-moral values or practical, first-person considerations—Darwall elaborates the interpersonal nature of moral obligations: their inherent link to our responsibilities to one another as members of the moral community. As Darwall defines it, the concept of moral obligation has an irreducibly second-person aspect; it presupposes our authority to make claims and demands on one another. And so too do many other central notions, including those of rights, the dignity of and respect for persons, and the very concept of person itself. The result is nothing less than a fundamental reorientation of moral theory that enables it at last to account for morality’s supreme authority—an account that Darwall carries from the realm of theory to the practical world of second-person attitudes, emotions, and actions.

The central claim of this work is that far from standing apart from the political realm, judicial independence is a product of it. It is defined and protected through interactions between judges and politicians. In short, judicial independence is a political achievement. This is the main conclusion of a three-year research project on the major changes introduced by the Constitutional Reform Act 2005, and the consequences for judicial independence and accountability. The authors interviewed over 150 judges, politicians, civil servants and practitioners to understand the day-to-day processes of negotiation and interaction between politicians and judges. They conclude that the greatest threat to judicial independence in future may lie not from politicians actively seeking to undermine the courts, but rather from their increasing disengagement from the justice system and the judiciary.

These are the sorts of headlines regularly generated by offices of inspector general (OIGs)—bureaucratic units dedicated to government accountability that are commonly independent of the agencies they are charged with overseeing. In 1976, OIGs were virtually unheard of and were largely at the federal level, but today there are more than 170 OIGs overseeing state and local government entities. Why have OIGs been so widely adopted, and what do they do? How do they contribute to accountability, and what are their limitations? In The Power of Accountability Robin J. Kempf sets out to address these questions with empirical data and to examine the conflicts that have led to variations in the design and implementation of OIGs. In doing so she explores the power of the concept of the inspector general: an institutional model for keeping subnational government units accountable to the public. As more and more government entities have created offices of inspector general, practitioners in this developing field have recommended an archetypal structure for these agencies that assures their authority and independence. Why then, The Power of Accountability asks, have so many states and localities incorporated significant deviations from this recommended model in their design? Through an extensive review of government websites, laws, and ordinances; original surveys of the identified OIGs; legislative histories; and interviews with thirty-eight OIG staff in eight states, Kempf analyzes why OIGs have proliferated, why and how they work differently in various jurisdictions, and what effect these variations in design have on the effectiveness of OIGs as a mechanism of accountability. The ever-expanding call for accountability in government drives the increasing demand for offices of inspector general, which necessarily entails intense political maneuvering. The Power of Accountability is a uniquely useful resource for judging whether, under what circumstances, and how well OIGs fulfill their intended purpose and serve the public interest.
