Spence National Defense Authorization Act of 2001 (the Act) required that I, as Comptroller General of the United States, "convene a panel of experts to study the policies and procedures governing the transfer of commercial activities for the Federal Government from Government personnel to a Federal contractor ..." In accordance with the Act, I am pleased to transmit to Congress the report of the Commercial Activities Panel (the Panel) convened to satisfy this statutory requirement. Given the importance of this issue, I elected to chair this Panel and ensured that it was comprised of highly qualified and empowered representatives from the groups specified in the Act and other knowledgeable individuals. A diverse group of high-level members were selected as panelists in order to broaden the scope and enhance the quality of our deliberations, while increasing our chances of success.

Book excerpt: The Commercial Activities Panel is a congressionally mandated panel to study, and make recommendations for improving, the policies and procedures governing the transfer of commercial activities from government to contractor personnel. The growing controversy surrounding competitions under the Office of Management and Budget's Circular A-76 to determine whether the government should obtain commercially available goods and services from the public or private sectors led to the establishment of this Panel. In establishing the Panel, several steps were taken to ensure representation from all major stakeholders as well as to ensure a fair and balanced process. To ensure a broad range of views on the Panel, a Federal Register notice was used to seek suggestions for the Panel's composition. As the Panel began its work, it recognized the need for a set of principles for sourcing decisions. These principles provide for an assessment of what does or does not work in the current A-76 process and provide a framework for identifying needed changes. Many of the Panel's recommendations can be accomplished administratively under existing law, and the Panel recommends that they be implemented as soon as practical. The Panel also recognizes that some of the recommendations would require changes in statutes or regulations that could take some time. Any legislative changes should be comprehensive and considered to achieve a reasonable balance.

Book excerpt: In May 2003, the Office of Management and Budget (OMB) released a revised Circular A-76, which represents a comprehensive set of changes to the rules governing competitive sourcing--one of five governmentwide items in the President's Management Agenda. Determining whether to obtain services in-house or through commercial contracts is an important economic and strategic decision for agencies, and the use of Circular A-76 is expected to grow throughout the federal government. In the past, however, the A-76 process has been difficult to implement, and the impact on the morale of the federal workforce has been profound. Concerns in the public and private sectors were also raised about the timeliness and fairness of the process for public-private competitions. It was against this backdrop that the Congress enacted legislation mandating a study of the A-76 process, which was carried out by the Commercial Activities Panel, chaired by the Comptroller General of the United States. This testimony focuses on how the new Circular addresses the Panel's recommendations reported in April 2002, the challenges agencies may face in implementing the new Circular A-76, and the need for effective workforce practices to help ensure the successful implementation of competitive sourcing in the federal government. The revised Circular A-76 is generally consistent with the Commercial Activities Panel's principles and recommendations, and should provide an improved foundation for competitive sourcing decisions in the federal government. In particular, the new Circular permits greater reliance on procedures in the Federal Acquisition Regulation--which should result in a more transparent and consistently applied competitive process--as well as source selection decisions based on trade-offs between technical factors and cost. The new Circular also suggests the potential use of alternatives to the competitive sourcing process, such as public-private and public-public partnerships. However, implementing the new Circular will likely be challenging for many agencies. Foremost among the challenges that agencies face is setting and meeting appropriate goals integrated with other priorities, as opposed to arbitrary quotas. Additionally, there are potential issues with the streamlined cost comparison process and protest rights. The revised streamlined process lacks a number of key features designed to ensure that agency sourcing decisions are sound, including the absence of an appeal process. Finally, the right of in-house competitors to file a bid protest at GAO challenging the sourcing decisions in favor of the private sector remains an open question. For many agencies, effective implementation will depend on their ability to understand that their workforce is their most important organizational asset. Agencies will need to aid their workforce in transitioning to a competitive sourcing environment. For example, agencies will need a skilled workforce and adequate infrastructure and funding to manage competitions; to prepare the in-house offer; and to oversee the cost, quality, and performance of whichever service provider is selected.

Book excerpt: Predicting how sourcing and supply chain strategies will change post COVID-19 is difficult, as change depends on factors such as the evolution of the pandemic, government policies and market conditions. The purpose of this research was to provide assessment of current and future sourcing leaders on suppliers and supply chain management during major disruptions caused by pandemics or disasters. Before the pandemic, most organizations expanded to offshore sourcing to control cost of raw material, labor, and final finished products. With the pandemic in full motion, organizations realized their increased dependence on offshoring as they struggled with increased transportation cost, transportation time due to shortage in vessels and delays at the major ports, raw material and labor shortages, and increased lead time. This study investigated sourcing strategy changes over the next 2-3 years (~2023-2025) as a direct response to COVID-19. This study focuses on how the pandemic drove organizations and sourcing leaders to change their sourcing strategy, decision making process and perception to affect the change. Beyond the pandemic, organizations will continuously change to effectively react to environmental, political, technological advancement, manufacturing landscape and changing laws globally. Knowing how to anticipate and mitigate risk and having the ability to shift and lift may contribute directly to increased sale and improving the top and bottom lines. Key study findings derived from emergent themes based on participant interview analysis. Organizations must anticipate and manage supply chain risks and evaluate adjacencies to products and consider cost and lead time differentials while making sourcing decisions. The importance of collaboration between sourcing, engineering, IT, and finance was also emphasized to account for the total cost of ownership and to evaluate the cost of recovery in case of contingencies. The pandemic highlighted the need to move away from China due to the increased logistical challenges and the way the Chinese government handled the pandemic. Study participants stressed the importance of dual sourcing and local for local strategies, continued collaboration with suppliers to understand total cost, transparency, sustainability, and organization's rank on the supplier's priority list when faced by supply disruption.
