Book Implementing Environmental Constitutionalism

Download or read book Implementing Environmental Constitutionalism written by Erin Daly and published by Cambridge University Press. This book was released on 2018-11-08 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutions can play a central role in responding to environmental challenges, such as pollution, biodiversity loss, lack of drinking water, and climate change. The vast majority of people on earth live under constitutional systems that protect the environment or recognize environmental rights. Such environmental constitutionalism, however, falls short without effective implementation by policymakers, advocates and jurists. Implementing Environmental Constitutionalism: Current Global Challenges explains and explores this 'implementation gap'. This collection is both broad and deep. While some of the essays analyze crosscutting themes, such as climate change and the need for rule of law that affect the implementation of environmental constitutionalism throughout the world, others delve deeply into geographically contextual experiences for lessons about how constitutional environmental law might be more effectively implemented. This volume informs global conversations about whether and how environmental constitutionalism can be made more effective to protect the natural environment.

Book Reforming Africa s Institutions

Download or read book Reforming Africa s Institutions written by Steve Kayizzi-Mugerwa and published by . This book was released on 2003 with total page 388 pages. Available in PDF, EPUB and Kindle. Book excerpt: There is not a single African country that did not attempt public sector reforms in the 1990s. Governments no longer see themselves as sole suppliers of social services, frequently opting for partnerships with the private sector. Efficiency and choice have entered the language of the planning and implementation units of Africa's line ministries, while privatization is no longer the controversial subject it was a decade ago. There have also been moves towards more open and democratic governments. Reforming Africa's Institutions looks at the extent to which reforms undertaken in Sub-Saharan Africa in recent years have enhanced institutional capacities across the breadth of government. To what extent have reforms been internalized and defended by governments? The authors also look specifically at the impact of public sector reforms on these economies and pose the question whether 'ownership can be attained when countries continue to be heavily dependent on external support. The volume is presented in three parts. The first focuses on the issue of reform ownership; on the issues of governance, the political economy of reform ownership, and the contradictions inherent in using aid as an instrument for enhancing domestic reform ownership. Part two examines the nature of incentives in the African civil service and the reforms undertaken in recent years to raise public sector efficiency in Africa. The third part discusses issues related to institutional capabilities in Africa and how they have been affected by the reforms undertaken in the 1990s, including privatization and movement towards political pluralism.

Available in PDF, EPUB and Kindle. Book excerpt: Nigeria at 100 is an attempt to document in modest and constructive language Nigeria's journey as a modern nation in the past 100 years, highlighting the landmark events during this period. the book is divided into four parts with a total of 22 chapters. The first part, with seven chapters deals with the historical background starting with the early history and covering the pre-colonial years, independence and the challenges of nationhood, military intervention in politics and governance, the civil war, the return to democracy and the continuing challenges of development. Part 2, which examines the major impediments to nation building, has a total of five chapters covering such important subjects as the leadership problem, the negative problem of ethnicity, the perennial and the disturbing problem of corruption. Part 3 makes a case for healing our national wounds through national reconciliation, transformation and patriotism. This part of the book also makes a case for a united, viable and stable Nigerian nation. Part 4 attempts to answer the question as to which direction Nigeria should be heading as a nation after the centenary celebrations. Since the emphasis in our general theme is change to a better society by way of transformation and reformation, especially in the critical areas identified in this book, this section starts with the role of the family as the unit that lays the foundation and sets the values that influence the character, judgement and behaviour of our young people who will subsequently become important citizens and members of the leadership elite.

Book Global Environmental Constitutionalism

Download or read book Global Environmental Constitutionalism written by James R. May and published by Cambridge University Press. This book was released on 2015 with total page 427 pages. Available in PDF, EPUB and Kindle. Book excerpt: Reflecting a global trend, scores of countries have affirmed that their citizens are entitled to healthy air, water, and land and that their constitution should guarantee certain environmental rights. This book examines the increasing recognition that the environment is a proper subject for protection in constitutional texts and for vindication by constitutional courts. This phenomenon, which the authors call environmental constitutionalism, represents the confluence of constitutional law, international law, human rights, and environmental law. National apex and constitutional courts are exhibiting a growing interest in environmental rights, and as courts become more aware of what their peers are doing, this momentum is likely to increase. This book explains why such provisions came into being, how they are expressed, and the extent to which they have been, and might be, enforced judicially. It is a singular resource for evaluating the content of and hope for constitutional environmental rights.

Book A Practical Guide to Constitution Building

Download or read book A Practical Guide to Constitution Building written by Winluck Wahiu and published by . This book was released on 2011 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: "A Practical Guide to Constitution Building provides an essential foundation for understanding constitutions and constitution building. Full of world examples of ground-breaking agreements and innovative provisions adopted during processes of constitutional change, the Guide offers a wide range of examples of how constitutions develop and how their development can establish and entrench democratic values. Beyond comparative examples, the Guide contains in-depth analysis of key components of constitutions and the forces of change that shape them. The Guide analyzes the adoption of the substantive elements of a new constitution by looking at forces for the aggregation or dissemination of governmental power, and forces for greater legalization or politicization of governmental power, and examining how these forces influence the content of the constitution. It urges practitioners to look carefully at the forces at play within their individual contexts in order to better understand constitutional dynamics and play a role in shaping a constitution that will put into place a functioning democratic government and foster lasting peace."--
