These laws and regulations impose serious restrictions on the movements of convicted sex offenders. This is controversial because these laws and regulations occur after the sex offender has completed his time in prison. These laws and regulations are intended to have both a deterrent and therapeutic effect. Residency restrictions seek to prevent sex offenders from recommitting their crimes and civil commitment provides psychological services while incarcerated in a forensic facility. Most works on this subject are deeply critical of these laws. Cary Federman takes a more sympathetic approach to sex offender legislation. He focuses on the deliberative intentions of legislators, exploring the limits of judicial review and the rights of interested parties to influence lawmaking. Leaders of these interested parties are usually the parents of children who have been sexually violated and murdered. Critics of sex offender legislation tend to focus on the convicted parties, arguing that their rights have been violated. Democracy and Deliberation asserts that these laws are expressions of the deliberative intentions of lawmakers concerned about public safety—they are thus constitutional, if not always wise.

Book excerpt: The use of residency restriction laws to monitor and control the movements of registered sex offenders in the United States has gained momentum in recent years since the passage of the first federal laws mandating sex offender registries. More than 30 states and hundreds of cities and towns have passed these laws. The purported theory behind residency restriction laws is to prevent registered sex offenders from possible interactions with potential victims. While the residency restriction laws may be theoretically sound, in practice there has been little in the way of empirical proof that they work as designed. As of yet, Massachusetts does not have a statewide residency restriction law, however, there is continuing pressure to enact one. This study explored the possible effects of such a law on those who would be most affected by it: registered sex offenders in Massachusetts. The theoretical framework drew upon social exclusion, disintegration, and labeling theories regarding the potential effects of residency restriction. One hundred registered sex offenders were selected to take part in a survey responding to 12 statements designed to determine their perceptions and attitudes towards potential residency restriction laws. The survey was followed by open-ended interviews with ten of the participating registered sex offenders. The results of the survey and the interviews show that the vast majority of the participants felt that the residency restriction laws would hinder their ability to reintegrate into society. Such findings consequently suggest that new laws would not provide additional safety to potential victims and might instead lead to increased recidivism (repeat offending).

As a result, there are more than 600,000 registered sex offenders, including individuals convicted of sexual sex between teenagers, prostitution, and public urination, as well as those who committed their only offenses decades ago. Unfettered public access to online sex offender registries exposes registrants to harassment, ostracism, and even violence, with little evidence that this form of community notification protects anyone from sexual violence. Residency restrictions prohibit former offenders from living within a designated distance (anywhere from 500 to 2,500 feet) from places where children gather. The restrictions have the effect of banishing former offenders from entire towns, forcing them to live far from home, families, jobs, and treatment, and hindering law-enforcement supervision. The restrictions may have no impact on the likelihood of recidivism. Sex offender laws reflect public concern that children are at grave risk of sexual abuse by strangers who are repeat offenders. The real risks children face are quite different: statistics demonstrate that most sexual abuse of children is committed by family members or persons known and often trusted by the victim, and by someone who has not previously been convicted of a sex offense. The laws also reflect the widely shared but erroneous belief that sex offenders continually repeat their offenses. Authoritative studies, however, indicate that three out of four adult offenders do not reoffend.

Discussions regarding neighborhood stability and its relationship with where convicted sex offenders are permitted to live are rich and detailed, providing evidence that such restrictions do not serve their intended purpose. The surge in such restrictive ordinances has created something of a "domino effect" among neighboring political jurisdictions, all attempting to prevent these offenders restricted from one location from moving into their own. Despite the potential questions arising from such edge areas, little research has been performed analyzing the effects of differing laws on sex offender residency patterns through a multi-jurisdictional region. This study is one such attempt to analyze how varying restrictive ordinances between three states and counties in the Greater Cincinnati area affect the spatial distribution of sex offender residencies.
