From afar, the Upper Huallaga became a political and legal no-man's-land. Up close, vibrant networks of connection endured despite strict controls on human habitation and movement. This book asks what happens to such a place once prolonged conflict has ostensibly passed. How have ordinary encounters with land, territory, and law, and with the river that runs through them all, been altered in the aftermaths of war? Gathering stories and images to render the experiences of transportation workers who have ferried passengers and things across and along the river for decades, Richard Kernaghan elaborates a notion of legal topographies to understand how landscape interventions shape routes, craft territories, and muddle temporalities. Drawing on personal narratives and everyday practices of transit, this ethnography conveys how prior times of violence have silently accrued: in bridges and roads demolished, then rebuilt; in makeshift moorings that facilitate both licit and illegal trades; and above all through the river, a liquid barrier and current with unstable banks, whose intricate mesh of tributaries partitions terrains now laden with material traces and political effects of a recent yet far from finished past.

Specifically, the book examines why states that adopt and ostensibly implement transitional justice norms as policies—criminal prosecutions, reparations policies, and truth commissions—fail to follow through with their recommendations. Applying these perspectives to a comparative study of states from Latin America and East Asia—namely, Peru, Uruguay, and South Korea—which accepted and implemented transitional justice norms but took different trajectories of behavior after the implementation of policies, this book contributes to understanding the relationship of norm influence on states and why states change in compliance after norm adoption. The book explores the conditions that contribute or limit the continued respect for transitional justice norms, emphasizing the political interests and transnational advocacy networks’ roles in affecting states’ policies of addressing past abuses.

Book excerpt: This book provides an in-depth look into key political dynamics that obtain in a democracy without parties, offering a window into political undercurrents increasingly in evidence throughout the Latin American region, where political parties are withering. For the past three decades, Peru has showcased a political universe populated by amateur politicians and the dominance of personalism as the main party–voter linkage form. The study peruses the post-2000 evolution of some of the key Peruvian electoral vehicles and classifies the partisan universe as a party non-system. There are several elements endogenous to personalist electoral vehicles that perpetuate partylessness, contributing to the absence of party building. The book also examines electoral dynamics in partyless settings, centrally shaped by effective electoral supply, personal brands, contingency, and iterated rounds of strategic voting calculi. Given the scarcity of information electoral vehicles provide, as well as the enormously complex political environment Peruvian citizens inhabit, personal brands provide readymade informational shortcuts that simplify the political world. The concept of “negative legitimacy environments” is furnished to capture political settings comprised of supermajorities of floating voters, pervasive negative political identities, and a generic citizen preference for newcomers and political outsiders. Such environments, increasingly present throughout Latin America, produce several deleterious effects, including high political uncertainty, incumbency disadvantage, and political time compression. Peru’s “democracy without parties” fails to deliver essential democratic functions including governability, responsiveness, horizontal and vertical accountability, or democratic representation, among others.
