It delineates the distinctions among discretionary, mandatory, & presumptive waivers. Direct file provisions, which typically authorize the prosecutor to determine the jurisdiction based on age/offense categories, are described, as are statutory exclusions, which remove certain offenses or age/offense categories from the jurisdiction of the juvenile court.

Book excerpt: We analyze the effects of tougher and weaker state laws governing the transfer of juveniles to the adult criminal justice system (including the statutory exclusion, once adult/always adult, direct file, presumptive waiver, discretionary waiver, and mandatory waiver laws, which make juvenile transfers to the adult system easier, and the reverse waiver law, which makes transfers to the adult system harder) on juvenile crime in different crime categories (including the general categories of total, property, and violent crime and the specific categories of murder, rape, assault, robbery, burglary, larceny, auto theft, and arson). We find that each of the tougher juvenile transfer laws is positively correlated with juvenile crime in at least one category, while the weaker juvenile transfer law (the reverse waiver) is negatively correlated with juvenile crime in several categories. Moreover, instrumental variable regressions indicate that increases in the combined severity of all the juvenile transfer laws cause increases in juvenile burglary.

The authors compare the extant literature with findings from the Pathways study and discuss the possible implications of these findings for future changes in transfer statutes. Following aresome key points:* Adolescents in the adult system may be at risk for disruptions in their personal development, identity formation, relationships, learning, growth in skills and competencies, and positive movement into adult status.* Most of the youth in the study who were sent to adult facilities returned to the community within a few years, varying widely in their levels of adjustment. Youth were more likely to successfully adjust when they were not influenced by antisocial peers.* Prior work indicates that transferred youth are more likely to commit criminal acts than adolescents kept in the juvenile justice system.* Findings from the Pathways study indicate that transfer may have a differential effect (either reducing or increasing offending), dependingon the juvenile's presenting offense and prior offense history.

Book excerpt: In the 1980s and 1990s, legislatures in nearly every state expanded transfer laws that allowed or required the prosecution of juveniles in adult criminal courts. The impact of these historic changes is difficult to assess inasmuch as there are no national data sets that track youth who have been tried and sentenced in the criminal justice system. Moreover, state data are hard to find and even more difficult to assess accurately. In addition to providing the latest overview of state transfer laws and practices, this bulletin comprehensively examines available state-level data on juveniles adjudicated in the criminal justice system. In documenting state reporting practices regarding the criminal processing of youth and identifying critical information gaps, it represents an important step forward in understanding the impact of state transfer laws. Currently, only 13 states publicly report the total number of their transfers, and even fewer report offense profiles, demographic characteristics, or details regarding processing and sentencing. Although nearly 14,000 transfers can be derived from available 2007 sources, data from 29 states are missing from that total. To obtain the critical information that policymakers, planners, and other concerned citizens need to assess the impact of expanded transfer laws, we must extend our knowledge of the prosecution of juveniles in criminal courts. The information provided in these pages and the processes used to attain it will help inform the focus and design of additional federally sponsored research to that end.

Book excerpt: This study will examine the relationship between juvenile transfer laws, certified juveniles, the criminal justice system, and the potential collateral consequences juveniles face when subjected to juvenile transfer laws. To obtain a deeper understanding of the impact of juvenile transfer laws and their potential collateral consequences, a qualitative study will be conducted utilizing several methods of data collection to include interviews; observations; and textual analysis of adult 1, adult 2, and criminal justice practitioners, to include, jail administrator, corrections officer, police, probation and parole officer, prosecuting attorney, and DOC staff. In the interview process, information will be gathered to contribute to the existing body of literature regarding the effects of juvenile transfer laws upon the juvenile and the criminal justice practitioners above. Quantitative data will also be used to show the number of juveniles transferred in the state of Missouri within the last ten years. In addition, information will be gathered through covert observations through interaction with the juvenile subject to juvenile transfer laws. Finally, information will be gathered using textual analysis to analyze current literature on juvenile transfer laws and the potential collateral consequences juveniles are subjected to when entering and exiting the criminal justice system. The findings of this research could possibly paint a different picture of juvenile transfer laws, juvenile offenders, the juvenile justice system that was designed to help them, as well as shed light on any collateral consequences juveniles may face.
