Nicolas Bernard nous propose ensuite l'étude et l'examen de deux droits réels immobiliers qui sont de plus en plus souvent utilisés dans la pratique : l'emphytéose et la superficie. Le droit réel qui a sans doute été le plus impacté par la réforme est l'usufruit. Alain-Charles Van Gysel et Vincent Wyart nous expliquent quelles sont les conséquences de ces modifications et comment les notaires devront à l'avenir conseiller tant les usufruitiers que les nus-propriétaires. Jean-François Romain traite ensuite des incursions du droit des biens dans le droit des obligations. C'est un sujet qui s'avère intéressant pour les notaires en charge de rédiger les actes relatifs à ces obligations qui portent des droits réels immobiliers. Enfin, Laurent Barnich nous explique quels sont les nouveaux actes transcrits dans les registres de la documentation patrimoniale. Il commente également le nouveau régime des mentions marginales.

Telles sont les questions au cœur de cet ouvrage. The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Phenomena such as increasing life expectancy, population urbanization, labor-market entry barriers, decline of traditional family patterns, mark in depth our contemporary world and involve old solidarity disappearance and new solidarity emergence, reshaping relations between generations while bringing up the problem of the fate of the most vulnerable: children, the sick, disabled, and especially elderly people. – What then is the role of families and communities in protecting these people? – What is the relationship between public and private solidarity? – What are the rights and freedoms of people placed by age, illness or disability in a dependence situation? These are the issues addressed by the authors of this book.

The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
