Book excerpt: Section 287(g) of the Immigration and Nationality Act, as amended, authorizes the federal government to enter into agreements with state and local law enforcement agencies to train officers to assist in identifying those individuals who are in the country illegally. U.S. Immigration and Customs Enforcement (ICE) is responsible for supervising state and local officers under this program. GAO was asked to review this program. This report reviews (1) the extent to which ICE has designed controls to govern 287(g) program implementation; and (2) how program resources are being used and the activities, benefits, and concerns reported by participating agencies. GAO reviewed memorandums of agreement (MOA) between ICE and the 29 program participants as of September 1, 2007. GAO compared controls ICE designed to govern the 287(g) program with criteria in GAO's Standards for Internal Control in the Federal Government. GAO interviewed officials from both ICE and participating agencies on program implementation, resources, and results. Among other things, GAO recommends that the Assistant Secretary for ICE document the program objective, document and communicate supervisory activities, and specify data each agency is to collect and report.

Book excerpt: Almost 12 million out-of-status aliens currently reside in the United States, and it is estimated that it will take 15 years and more than $5 billion for the Department of Homeland Security's Immigration and Customs Enforcement to apprehend just the current backlog of absconders. One proposed solution to this enforcement problem is for federal agencies to partner with state and local law-enforcement agencies to apprehend and deport fugitive aliens. Currently, the federal government does not require state and local agencies to carry out specific immigration enforcement actions; however, comprehensive immigration reform may address this issue in the near future. Before such legislation is drafted and considered, it is important to understand all the potential impacts of a policy incorporating immigration enforcement by nonfederal entities. As there is very limited evidence about the effects of involving state and local law enforcement in immigration enforcement duties, the authors seek to clarify the needs and concerns of key stakeholders by describing variations in enforcement approaches and making their pros and cons more explicit. They also suggest areas for research to add empirical evidence to the largely anecdotal accounts that now characterize discussions of the involvement of state and local law enforcement in immigration enforcement efforts.

Book excerpt: Immigration enforcement is carried out by a complex legal and administrative system, operating under frequently changing legislative mandates and policy guidance, with authority and funding spread across several agencies in two executive departments and the courts. The U.S. Department of Homeland Security (DHS) is responsible for conducting immigration enforcement both at the border and in the United States; the U.S. Department of Justice (DOJ) is responsible for conducting immigration removal procedures and criminal trials and for prosecuting people charged with immigration-related crimes. DOJ confronts at least five technical challenges to modeling its resource needs for immigration enforcement that are specific to the immigration enforcement system. Despite the inherent limitations, budgeting for immigration enforcement can be improved by changing the method for budgeting. Budgeting for Immigration Enforcement addresses how to improve budgeting for the federal immigration enforcement system, specifically focusing on the parts of that system that are operated and funded by the U.S. Department of Justice (DOJ). The report recommends that DOJ establish policy-level procedures to plan and coordinate policy planning and implementation to improve performance of the immigration enforcement system. The report also recommends that DOJ and DHS accelerate their design of an integrated capacity to track cases and project immigration enforcement activity. Policy makers and others who are interested in how the nation's immigration enforcement system is organized and operates also will find it useful.

Book excerpt: The issue of 12-20 million illegally-present foreign nationals within the United States brings with it a number of homeland security questions and concerns. The threat of terror organizations utilizing our porous borders or lack of enforcement against us is highly probable. However, in order to deal with the issue of illegal immigration and the homeland security threat that is attached to this problem, the country must develop a strategy that is efficient and effective for all. One possible strategy for combating illegal immigration is the utilization of section 287(g) of the Immigration and Nationality Act, which grants, under limited conditions, law enforcement agencies the authority to use immigration-related information to advance local policing efforts. However, the issue of state and local enforcement of immigration-related matters has become highly contentious. Much has been written about it, but little data has been collected on what these enforcement programs actually do, rather than what supporters and opponents hope or fear they will do. The purpose of this thesis was to examine several situations in which state and local agencies have implemented the 287(g) program. While it is true the use of this authority as a strategy has many factors and elements that must be reviewed prior to further implementation, it is in reality a necessary partnership and prudent measure to keep our nation and our communities safe. The 287(g) program should be strongly considered a national strategy for combating illegal immigration.

Book excerpt: This essay, part of a symposium held at the University of Virginia, defends the importance of resolute enforcement in sustaining generous immigration policy, particularly America's singularly high lawful admission levels and relatively successful immigrant integration record. Drawing on other studies and the author's experiences in government service, the paper explores the risks to humane policy when the public perceives that migration is out of control. The public reaction to the Mariel boatlift, Congress's enactment of harsh enforcement measures in 1996, and the Obama administration's stern response to the child migrant crisis of 2014 illustrate the point. Though the current period is relatively quiet on the public opinion front, that situation is fragile, highly dependent on the relatively low net inflow of unauthorized migrants. The essay then examines specific ideas for building a truly effective and sustainable enforcement system. All would work far better if accompanied by an expansive one-time statutory legalization program - which is both a humane response to the reality of long-resident populations and a step that would empower more resolute enforcement against newer violators. (1) E-Verify holds real promise, but Congress and the executive are too complacent about its vulnerability to identity fraud. Congress should provide strong inducements for states to share driver's license photos to be used in E-Verify's “photo tool.” (2) Stronger enforcement against visa overstays would foster a culture of compliance with the immigration laws. It is a misconception that we need first to build a biometric exit monitoring system; existing biographic data systems, built in the wake of 9/11, are sufficient once the political will to curb and deter overstays exists. (3) Revitalized and carefully designed cooperation with state and local law enforcement agencies (LEAs) is also a crucial element. The essay recounts the history of Secure Communities (SC), a fundamentally sound and efficient program that wound up losing support through mistakes in implementation, bad timing (rolled out when it could affect many long-resident unauthorized migrants based on minimal apparent criminal violations), and skillful litigation attacking immigration detainers. The Secretary of Homeland Security terminated SC in November 2014, replacing it with a new Priority Enforcement Program. This change addressed most LEA objections but preserved key enforcement efficiencies pioneered through SC, while laying the groundwork for eventually rebuilding sound LEA cooperation. (4) Congress should restore wider versions of discretionary relief from removal available in immigration court, to provide a more professional and reliable means (as compared to prosecutorial discretion) to soften the harsh edges of enforcement and thereby foster public support.
