Book excerpt: In 2009, the International Labour Organization (ILO) celebrated its ninetieth anniversary. The First World War and the revolutionary wave it provoked in Russia and elsewhere were powerful inspirations for the founding of the ILO. There was a growing understanding that social justice, in particular by improving labour conditions, was an essential precondition for universal peace. Since then, the ILO has seen successes and set-backs; it has been ridiculed and praised. Much has been written about the ILO; there are semi-official histories and some critical studies on the organization's history have recently been published. Yet, further source-based critical and comprehensive analyses of the organization's origins and development are still lacking. The present collection of eighteen essays is an attempt to change this unsatisfactory situation by complementing those histories that already exist, exploring new topics, and offering new perspectives. It is guided by the observation that the ILO's history is not primarily about «elaborating beautiful texts and collecting impressive instruments for ratification» but about effecting «real change and more happiness in peoples' lives».

Book excerpt: This monograph provides an extensive analysis of the powers of judicial review exercised by the International Court of Justice with respect to judgments of the Administrative Tribunals of the International Labour Organization and the United Nations. The grounds on which these judgments can be challenged include excess jurisdiction, procedural errors and errors of law relative to the Charter of the United Nations. The system, however, suffers from a number of difficulties, including lack of procedural equality, the propriety of employing the Court's advisory jurisdiction in employer-employee disputes, and the nature of the activities of the Review Committee of the General Assembly. These problems are examined with a view to shedding light on the nature, scope and extent of the Court's powers of judicial review. The main study is preceded by an exhaustive survey of the genesis of the review system established by the Statutes of these Tribunals. Included also in this volume is an account of the informal and rudimentary judicial review arrangement the Court enjoys by way of its advisory and contentious jurisdiction with respect to institutional action other than that of UNAT and ILOAT judgments. When in 1995 the General Assembly abolished the UNAT review system, various considerations were in the forefront: a detailed survey of which is provided in the penultimate part of the book. Several significant themes are explored in the concluding chapter. These include issues dealing with the motivation for establishing the review system, the divisions within the Court and possible reform, as opposed to abolition, of the system.

It examines the principles evident in the teachings of the Catholic Church and in the secular philosophy of the ILO; together with the theological basis of the relevant provisions of Catholic Social Teaching and of the socio-political origins and basis of the ILO. The spectrum of labour rights covered in the book extends from the right to press for rights, i.e., collective bargaining, to rights themselves – conditions in work – and on to post-employment rights in the form of social security and pensions. The extent of the parallelism and cross-influence is reviewed from the issue of the Papal Encyclical of Pope Leo XIII Rerum Novarum (1891) and from the founding of the ILO in 1919. Book excerpt: Founded in 1919 under the Treaty of Versailles as part of the League of Nations’ system, the ILO is still today the main organization responsible for the international organization of work and the improvement of working conditions in the world. Widely recognized for its efforts in building international labour standards, the ILO remains little studied by development specialists and historians. This book intends to fill this gap and traces the history of international development and its early pioneers, through an analysis of the activities of the International Labour Office, the Secretariat of the International Labour Organization, between 1930 and 1946. In this book, development is used as a key to questioning the ILO's place and function in the expanding inter-war world. The development practices and discourses that emerged in the 1930s were mainly intended to support the ILO's universalization strategy, which was made necessary by the events that shook Europe at the time. Development discourses and practices were also part of the "esprit du temps", as they were closely linked to the affirmation of the planist and rationalist ideas of the 1930s. However, development for the ILO was not reduced to a project of economic modernization, but was seen as a tool for social engineering, as evidenced by the ILO's missions of technical assistance, organized since 1930. The analysis of the expertise work makes it possible to highlight the logics that prevailed in technical assistance, which was more in line with institutional objectives, than with the dissemination of a genuine expertise. This book therefore hopes to bring new insight on the history of internationalism, and international organizations during the inter-war period and the Second World War, as well as on the role of the ILO in the history of international development thinking and practices.

Book excerpt: Platform work – the matching of the supply of and demand for paid labour through an online platform – often depends on workers who operate in a “grey area” between the archetype of an employee and a self-employed worker. This important book explores the utility of the International Labour Organization’s existing standards in governing this phenomenon. It indicates that despite their relevance, many standards have little or no impact. The standards apply to the issue but they fail to connect with it. The author shows how three ILO conventions – the Home Work Convention, 1996 (No. 177), the Private Employment Agencies Convention, 1997 (No. 181), and the Domestic Workers Convention, 2011 (No. 189) – can be revitalised to have an impact on the platform work debate. In the course of the analysis he responds in depth to such questions as the following: What are digital labour platforms? What does decent work mean? Did the ILO centenary fundamentally change anything? What is the link between private employment services and platform work? How do crowdworkers relate to homeworkers and teleworkers? Are platform workers engaged in domestic work? What form could a future ILO standard on platform work take? Given that the ILO plans to start discussions on a potential future standard for platform work in 2022, this book will prove very useful in highlighting the issues and standards that such discussions should consider. Research has shown that the techniques and tools of the platform economy have spread far beyond gig work, resulting in widespread “gigification” and restructuring of workplace behaviours and relationships, jobs, and communities across the world. For this and other reasons, including the book’s detailed analysis of issues not addressed elsewhere, labour lawyers, in-house counsel, researchers, and policymakers will gain valuable insight into what decent work in the platform economy would require, thus greatly broadening the discussion on this difficult-to-regulate phenomenon.
