What are the effects of interventions by the International Criminal Court (ICC) on the wars in which the institution intervenes? Is holding perpetrators of mass atrocities accountable a help or hindrance to conflict resolution? This book offers an in-depth examination of the effects of interventions by the ICC on peace, justice and conflict processes. The 'peace versus justice' debate, wherein it is argued that the ICC has either positive or negative effects on 'peace', has spawned in response to the Court's propensity to intervene in conflicts as they still rage. This book is a response to, and a critical engagement with, this debate. Building on theoretical and analytical insights from the fields of conflict and peace studies, conflict resolution, and negotiation theory, the book develops a novel analytical framework to study the Court's effects on peace, justice, and conflict processes. This framework is applied to two cases: Libya and northern Uganda. Drawing on extensive fieldwork, the core of the book examines the empirical effects of the ICC on each case. The book also examines why the ICC has the effects that it does, delineating the relationship between the interests of states that refer situations to the Court and the ICC's institutional interests, arguing that the negotiation of these interests determines which side of a conflict the ICC targets and thus its effects on peace, justice, and conflict processes. While the effects of the ICC's interventions are ultimately and inevitably mixed, the book makes a unique contribution to the empirical record on ICC interventions and presents a novel and sophisticated means of studying, analyzing, and understanding the effects of the Court's interventions in Libya, northern Uganda - and beyond.

Book excerpt: Political Rationale and International Consequences of the War in Libya focuses on the international intervention in Libya in 2011, and tries to answer two broad questions; (1) What was the political rationale for the various actors to proceed as they did in the lead-up and conduct of the military intervention in Libya?, (2) What are the consequences of the UN-authorized military intervention in Libya? R2P was the public raison d'etre of the war, and an important legitimizing factor of the intervention. Still, the humanitarian situation was a necessary, but not in and by itself an adequate precondition for intervention. A number of factors coalesced to enable the intervention. While the humanitarian situation triggered the intervention, in reality a variety of national interests governed the approach by the various international actors, and more often than not, these motives were not rooted in the particular circumstances in Libya. The book offers a combination of unique perspectives. While the perspectives of the US, France, and the UK on the Libyan Crisis/War have been well documented, the Arabic and Scandinavian political and military dynamics have been much less so. While the perspectives of NATO, the UN, and R2P have been debated, the view from the Arab League and African Union (AU) have been less in focus. The volume redresses that imbalance and offers the most broad-ranging analysis yet of a key moment in recent international relations.

Often, the challenges of post-conflict reconstruction revolve around the timing and sequencing of different reform that may have contradictory implications. Drawing on a range of thematic studies and empirical cases, this book examines how post-conflict reconstruction policies can be better sequenced in order to promote sustainable peace. The book provides evidence that many reforms that are often thought to be imperative in post-conflict societies may be better considered as long-term objectives, and that the immediate imperative for such societies should be 'people-centred' policies.

Traditionally, the decline of one empire leads to a restoration in the balance of power, via a struggle among rival systems of order. Yet this dynamic is surprisingly absent today; instead, the superpowers have all, at times, sought to promote what Jason Pack terms the 'Enduring Disorder'. He contends that Libya's ongoing conflict-more so than the civil wars in Yemen, Syria, Venezuela or Ukraine-constitutes the ideal microcosm in which to identify the salient features of this new era of geopolitics. The country's post-Qadhafi trajectory has been molded by the stark absence of coherent international diplomacy; while Libya's incremental implosion has precipitated cross-border contagion, further corroding global institutions and international partnership. Pack draws on over two decades of research in and on Libya and Syria to highlight the Kafkaesque aspects of today's global affairs. He shows how even the threats posed by the Arab Spring, and the Benghazi assassination of US Ambassador J. Christopher Stevens, couldn't occasion a unified Western response. Labelled with a digital code, they are moved along in the possession of the traffickers through a series of black holes, in which their access to digital technologies and connectivity is highly controlled. They are tortured, abused, extorted and subjected to sexual violence. Many die along the way. If they make it to the Mediterranean Sea, they risk being intercepted and returned to Libya or dying at sea. Over the period of this study (201721), it is conservatively estimated that at least 200,000 men, women and children have fallen victim to human trafficking for ransom in Libya, and the cumulative value of this trade for that period is estimated at over 1 billion USD. This detailed ethnographic study identifies the routes, modus operandi, organisation, and key actors involved in the human trafficking for ransom of refugees and migrants, who are desperately in need of protection. The book is part of the GAIC Research Network and African studies series published by Langaa RPCIG and makes an important contribution to the literature on human trafficking, migration studies, African studies, modern slavery, social protection and governance.

The intervention of external actors in the Libyan crisis was mainly driven by a desire to direct the transition towards outcomes that would best meet their own political and economic interests. Accordingly, each external player tried to support one specific faction, favoring either the Parliament in Tobruk, upheld by Khalifa Haftar, or the Presidential Council headed by Fayez al-Serraj in Tripoli, the latter being legitimized by the UN as well as by local militias in both Misrata and Tripoli. This report analyzes the troublesome re-building of Libya with a focus on the specific role played by international actors (neighboring and Gulf countries, European nations, Russia and the US) which make it more of an international rather than a domestic issue.
