Book excerpt: In 1947 a group of Yoruba-speaking fishermen who had been persecuted because of their religious beliefs founded their own community in order to worship in peace. Although located in an impoverished part of Nigeria, within a few years the village enjoyed remarkable economic success. This was partly because the fishermen held all goods in common, pooled the profits in the community treasury, and attempted to reduce the importance of the family and marriage. After about a generation the utopia began to fall apart. The early religious zeal faded, private enterprise replaced communalism, and the family became strong once more. In an attempt to explain the initial success and eventual decline of the utopia, the author compares it with neighbouring villages that embraced similar religious beliefs but did not enjoy the same economic success. He sets the problem firmly in a broad comparative framework and draws the implications for theories of development, especially Weber’s Protestant ethic thesis.

Book excerpt: The name Nigeria was coined in Lokoja by Flora Shaw, the future wife of Baron Lugard, a British colonial administrator, while gazing out at the river Niger. So, British colonialism created Nigeria as a country, joining diverse peoples and regions in an artificial political entity along the Niger River. The territory known today as Nigeria is a very large country of multi-ethnic groups of about four hundred. The land mass is large enough to accommodate France, Belgium and Italy. The name Nigeria is derived from the River Niger which traverses the country from the North to the South. Nigeria is located on the coast of Western Africa. It has an area of 356,669 square miles (923,768 square km). At its greatest expanse, it measures about 1,200 kilometres (about 750 mi) from East to West and about 1,050 kilometres (about 650 mi) from North to South. It is bordered to the north by Niger, the east by Chad and Cameroon, the south by the Gulf of Guinea, and to the west by Benin. Niger River and the Benue, are its largest tributary, are the principal rivers in the country. The area that is now Nigeria was home to ethnically based kingdoms and tribal communities before it became a European colony. In spite of European contact that began in the 16th century, these kingdoms and communities maintains their autonomy until the 19th century. Federal Republic of Nigeria is a constitutional Federal Republic comprising 36 states and the Federal Capital Territory in Abuja. The principal groups in the Northern part are Hausa, Fulani, Kanuri, and Nupe. Other minority tribes also inhabits the Middle belt area, these include the Jukun, the Chamba and the Bata. In the region north of the upper Benue valley various ethnic groups such as Fali, Gabun, Gude, Gudu, Higi, Hona Mbula, Mumuye and Tika also inhabits the area. In the Southwest we have the Yoruba, another principal ethnic group and in the Southeast we have the Igbo people which form the third principal ethnic group. In the South-south we have the group of minorities such as Annang, Efik, Ibibio, Ijaw, Itsekiri, Isoko Uhrobo and Ukwiani. The entire ethnic group in Nigeria is over 500, parts of these are listed in appropriate section of this book.

The Independent Electoral Commission INEC, departing from the norm, announced election results in Abuja, the federal capital, declaring the incumbent the winner. Mimiko contested this decision at the election tribunal and was adjudged winner at the tribunal and the Court of Appeal on February 23, 2009. The Appeal Court, liked the court of first instance, cited massive irregularities in the 2007 election, and ordered that Agagu be replaced by Mimiko as governor. Mimiko then became the first and only member of the Labour Party to win gubernatorial office in Nigeria. Governor Olusegun Mimiko contested and won re-election on October 20, 2012, for a second term, making him the first governor in Ondo State to win a second term election. Mimiko stood in that election as the Labour Party candidate for Nigeria’s Ondo State and polled the highest votes. The court drama that pitched Dr. Rahman Olusegun Mimiko against Dr. Olusegun Kokumo Agagu lasted for two years, 2007 to 2009. It consumed the energy of hundreds of lawyers and the attention of millions of Nigerians. On the one hand was the Mimiko team, considered the under-dog in the struggle, with only the rightness of their cause as their succour, and their belief that somehow, God was on their side. On the other hand was the Agagu team, the incumbent power supported by federal might and endless resources in money, material and confidence.

Often violated by their own governments, sometimes with support from transnational corporations, or nations benefiting from human rights violations, how can these victims find justice? Lawyers Beyond Borders reveals the inner workings of the advances and retreats in the quest for redress and restoration of human rights for those whom international legal-political systems have failed. The process of justice begins in the US, with a handful of human rights lawyers steeped in the American tradition of advancing civil rights through civil litigation. As the civil rights movement gained traction and an ample supply of lawyers, this small cadre turned their attention toward advancing international human rights, via the US legal system. They sought to build another piece of the rights revolution, this time for survivors of egregious human rights violations in faraway lands. These cases were among the most unlikely to be slated for victory: The abuses occurred abroad; the victims are aliens, usually with few, if any, resources; the perpetrators are politically powerful, resourced, and well connected, often members of governments, militaries, or multinational corporations. The legal and political systems’ structures are mostly stacked against these survivors, many who bear the scars of trauma and terror. Lawyers Beyond Borders is about agency. It is about how, in the face of powerful interests and seemingly insurmountable obstacles—political, psychological, economic, geographical, and physical—a small group of lawyers and survivors navigated a terrain of daunting barriers to begin building, case-by-case, new pathways to justice for those who otherwise would have none.
