L’iter processuale viene illustrato con grande chiarezza passo dopo passo: dalla competenza della giurisdizione, alle azioni esperibili; dalla legittimazione attiva (RTI) e passiva (Centrali di committenza), all’atto introduttivo, alle notifiche e al processo; fino ad arrivare all’esecuzione della sentenza e al giudizio in appello e in cassazione. Un’attenzione particolare, infine, viene riservato al tema fondamentale della responsabilità penale e di quella erariale. Suggerimenti operativi, segnalazioni di anomalie e criticità, approfondimenti, riepiloghi, schemi riassuntivi, tabelle, supportano il lettore nella consultazione, rendendo il testo immediatamente fruibile, e indirizzando l’operatore verso la soluzione del problema concreto. La trattazione è coordinata con un costante richiamo alla giurisprudenza e ai pareri Anac più recenti.

Book excerpt: PERBACCO (a free Italian acronym for Life-cycle Performance, Innovation and Design Criteria for Structures and Infrastructures Facing Æolian and Other Natural Hazards) is a research project partly funded by the Italian Ministry for University (MIUR) in the PRIN (Progetti di Ricerca di Interesse Nazionale) framework, for the years 2004-05.Within the project, a first attempt has been made to integrate different disciplines aiming at an overall optimization of the performance of a wide range of wind exposed structures and infrastructures, with consequent benefi cial impact on the society.The overall objectives were (a) to provide unifi ed concepts for "expected performance" and "risks induced by æolian and other natural hazards", to be applied to structures and infrastructures over their whole life-cycle, such to be acceptable to stakeholders in the construction process (i.e. from the owner to the end-user), (b) to provide models and methodologies for dynamic monitoring of the performance of structures and infrastructures, to be integrated in appropriately designed procedures, and (c) to collect, refi ne, fi le and disseminate the knowledge available on a European basis, concerning the performance of wind-exposed structures and facilities, in a way such to be of use to Construction Industry. This volume summarises the main results obtained during the Project, with each Section addressing a different class of problems, to which many research Units have contributed. A list of papers containing the main results of the research activities carried out within the Project is also provided in each Section.

Book excerpt: Since the Cold War ended, China has become a global symbol of disregard for human rights, while the United States has positioned itself as the world’s chief exporter of the rule of law. How did lawlessness become an axiom about Chineseness rather than a fact needing to be verified empirically, and how did the United States assume the mantle of law’s universal appeal? In a series of wide-ranging inquiries, Teemu Ruskola investigates the history of “legal Orientalism”: a set of globally circulating narratives about what law is and who has it. For example, why is China said not to have a history of corporate law, as a way of explaining its “failure” to develop capitalism on its own? Ruskola shows how a European tradition of philosophical prejudices about Chinese law developed into a distinctively American ideology of empire, influential to this day. The first Sino-U.S. treaty in 1844 authorized the extraterritorial application of American law in a putatively lawless China. A kind of legal imperialism, this practice long predated U.S. territorial colonialism after the Spanish-American War in 1898, and found its fullest expression in an American district court’s jurisdiction over the “District of China.” With urgent contemporary implications, legal Orientalism lives on in the enduring damage wrought on the U.S. Constitution by late nineteenth-century anti-Chinese immigration laws, and in the self-Orientalizing reforms of Chinese law today. In the global politics of trade and human rights, legal Orientalism continues to shape modern subjectivities, institutions, and geopolitics in powerful and unacknowledged ways.

This legal precedent for bringing a former head of state to trial outside his home country signaled that neither the immunity of a former head of state nor legal amnesties at home could shield participants in the crimes of military governments. It also allowed victims of torture and crimes against humanity to hope that their tormentors might be brought to justice. In this meticulously researched volume, Naomi Roht-Arriaza examines the implications of the litigation against members of the Chilean and Argentine military governments and traces their effects through similar cases in Latin American and Europe. Roht-Arriaza discusses the difficulties in bringing violators of human rights to justice at home, and considers the role of transitional justice in transnational prosecutions and investigations in the national courts of countries other than those where the crimes took place. She traces the roots of the landmark Pinochet case and follows its development and those of related cases, through Spain, the United Kingdom, elsewhere in Europe, and then through Chile, Argentina, Mexico, and the United States. She situates these transnational cases within the context of an emergent International Criminal Court, as well as the effectiveness of international law and of the lawyers, judges, and activists working together across continents to make a new legal paradigm a reality. Interviews and observations help to contextualize and dramatize these compelling cases. These cases have tremendous ramifications for the prospect of universal jurisdiction and will continue to resonate for years to come. Roht-Arriaza's deft navigation of these complicated legal proceedings elucidates the paradigm shift underlying this prosecution as well as the traction gained by advocacy networks promoting universal jurisdiction in recent decades.
