Nevertheless, as the events of the last decade made clear, the EU's complex system of governance has been unable to achieve a democratic or constitutional legitimacy in its own right. In Power and Legitimacy: Reconciling Europe and the Nation-State, Peter L. Lindseth traces the roots of this paradox to integration's dependence on the postwar constitutional settlement of administrative governance on the national level. Supranational policymaking has relied on various forms of oversight from national constitutional bodies, following models that were first developed in the administrative state and then translated into the European context. These national oversight mechanisms (executive, legislative, and judicial) have over the last half-century developed to address the central disconnect in the integration process: between the need for supranational regulatory power, on the one hand, and the persistence of national constitutional legitimacy, on the other. In defining the ways European public law has sought to reconcile these two conflicting demands, Professor Lindseth lays the foundation for a better understanding of the "administrative, not constitutional" nature of European governance going forward.

Sartori begins by assessing electoral systems. He attacks the conventional wisdom that their influence cannot be predicted and also disputes the view that proportional representation is always best and will deliver 'consensus democracy'. He argues that the double-ballot formulas deserve more consideration for their ability to facilitate governability in adverse circumstances. His comparative assessment of presidential and semi-presidential systems and the variety of formulas that are categorized, sometimes misleadingly, as parliamentary, looks at the conditions that allow a political form to perform as intended. He concludes with a detailed proposal for a new type of government: alternating presidentialism. This meets the need for strong parliamentary control and efficient government, with safeguards against both parliamentary obstructionism and government by decree, and so could help to avoid political paralysis in Latin America, in the post-communist countries of Europe and in countries with dysfunctional parliamentary systems such as Italy and Israel.

Book excerpt: In The Paradox of Representation David Lublin offers an unprecedented analysis of a vast range of rigorous, empirical evidence that exposes the central paradox of racial representation: Racial redistricting remains vital to the election of African Americans and Latinos but makes Congress less likely to adopt policies favored by blacks. Lublin's evidence, together with policy recommendations for improving minority representation, will make observers of the political scene reconsider the avenues to fair representation. Using data on all representatives elected to Congress between 1972 and 1994, Lublin examines the link between the racial composition of a congressional district and its representative's race as well as ideology. The author confirms the view that specially drawn districts must exist to ensure the election of African Americans and Latinos. He also shows, however, that a relatively small number of minorities in a district can lead to the election of a representative attentive to their interests. When African Americans and Latinos make up 40 percent of a district, according to Lublin's findings, they have a strong liberalizing influence on representatives of both parties; when they make up 55 percent, the district is almost certain to elect a minority representative. Lublin notes that particularly in the South, the practice of concentrating minority populations into a small number of districts decreases the liberal influence in the remaining areas. Thus, a handful of minority representatives, almost invariably Democrats, win elections, but so do a greater number of conservative Republicans. The author proposes that establishing a balance between majority-minority districts and districts where the minority population would be slightly more dispersed, making up 40 percent of a total district, would allow more African Americans to exercise more influence over their representatives.

Who Benefits from the Nonprofit Sector? examines all the major elements of the nonprofit sector - health services, educational and research institutions, religious organizations, social services, arts and cultural organizations, and foundations - describing each institution and its function, and then exploring how their benefits are distributed across various economic classes. The book's findings indicate that while few institutions serve primarily the poor, there is no evidence of a gross distribution of benefits upwards toward the more affluent. The source of an institution's funding is also shown to be an important determinant in how its benefits are distributed. They show, for example, that: . Nonprofit nursing homes and drug treatment centers have a lower concentration of Medicaid patients than their for-profit public counterparts do. Twenty-seven percent of social service agencies serve primarily the poor, and the large majority ofthese received most of their income from the federal government. The effective educational subsidy (i.e., cost of education less tuition) per person at both public and private univenities increases with income. The analysis of this data makes for a book with profound implications for future social and tax policy.
