It examines how the prosecution of those who bear the greatest responsibility for crimes committed in these countries may have negatively or positively influenced the process of making peace in their wake. It is concerned with how international accountability affects post-conflict countries and what the ICC brings to peace processes. The central question addressed by the book is whether justice spurs peace in post- conflict societies or whether justice complicates the peace process. If so, how? Relying on qualitative studies in these countries, this book comparatively analyses the impact of the interventions of the ICC in Uganda (2004), Kenya (after the 2007/2008 post-election violence), and Cȏte d’Ivoire. Its aim is to provide an evidence-based account of how the involvement of the ICC in these countries influences the processes of promoting peace. Quantitative, qualitative, and institutional analysis for each country is used to examine the modus operandi of capital flight; that is, the 'who', 'how', and 'where' dimensions of the phenomenon. 'Who' refers to major domestic and foreign players; 'how' refers to mechanisms of capital acquisition, transfer, and concealment; and 'where' refers to the destinations of capital flight and the transactions involved. The evidence reveals a complex network of actors and enablers involved in orchestrating and facilitating capital flight and the accumulation of private wealth in offshore secrecy jurisdictions. This underscores the reality that capital flight is a global phenomenon, and that measures to curtail it are a shared responsibility for Africa and the global community. Addressing the problem of capital flight and related issues such as trade misinvoicing, money laundering, tax evasion, and theft of public assets by political and economic elites will require national and global efforts with a high level of coordination.

Grillo draws on fieldwork in Côte d’Ivoire that spans three decades to illustrate how these rituals of Female Genital Power (FGP) constitute religious and political responses to abuses of power. Book excerpt: The end of the twentieth century, which was marked by multiparty democracy in Eastern European entities and Third World countries, moved Cte dIvoire to adhere to the new democratization system in 1990. Nine years later, the territory registered its first bloodless state coup. On September 19, 2002, the country was shared into two parts with human losses and damages when President Gbagbo was on official visit to Italy. After different attempts in negotiations (Linas-Marcoussis (2003), Pretoria agreement (2005), and the Political Agreement of Ouagadougou (2007)), for some protagonists, international organizations and NGOs, the perfect conflict resolution was about running elections so that the former peaceful land could regain its image of a prosperous and stable country. The elections that were delayed six times came to pass, and two presidents came out of the scrutiny. Gbagbo was proclaimed victorious by the Ivorian Constitutional Council, while Ouattara was acknowledged by the Independent Electoral Commission. Once more, the country fell into a postelection crisis. Meanwhile, the African Union, the European Union, the USA, the French Licorne, and the United Nations urged President Gbagbo to step down since Ouattara was considered the happy winner of the scrutiny. The refusal of Gbagbo cost human losses and led to his arrest on April 11, 2011. Nowadays, the country is not unified and reconciled, but it will have the 2015 elections.

The existence of civil war can dramatically slow a country's development process, especially in low-income countries which are more vulnerable to civil war conflict. Conversely, development can impede civil war. When development succeeds, countries become safer when development fails, they experience a greater risk of being caught in a conflict trap. Ultimately, civil war is a failure of development. 'Breaking the Conflict Trap' identifies the dire consequences that civil war has on the development process and offers three main findings. First, civil war has adverse ripple effects that are often not taken into account by those who determine whether wars start or end. Second, some countries are more likely than others to experience civil war conflict and thus, the risks of civil war differ considerably according to a country's characteristics including its economic stability. Finally, Breaking the Conflict Trap explores viable international measures that can be taken to reduce the global incidence of civil war and proposes a practical agenda for action. This book should serve as a wake up call to anyone in the international community who still thinks that development and conflict are distinct issues.

Book excerpt: State formation after civil war offers a new model for studying the formation of the state in a national peace transition as an integrated national phenomenon. Current models of peacebuilding and state building limit that possibility, reproducing a fragmented, selective view of this complex reality. Placing too much emphasis on state building as design they place too little on understanding state formation as unplanned historical process. The dominant focus on national institutions also ignores the role that cities and civic polities have played in constituting the modern state. Mining ideas from many disciplines and evidence from 19 peace processes, including South Africa, the book argues that the starting point for building a systematic theory is to explain a distinct pattern to state formation that can be observed in practice: Despite their conflicts people in fragile societies bargain terms for peaceful coexistence, they make attempts to constitute the right to rule as valid state authority, in circumstances prone to conflict, over which they have imperfect influence, not control. Though the kind of institutions created will differ with context, how rules for state authority are institutionalized follows a consistent basic pattern. That pattern defines state formation in peace transitions as both a unified, if contingent, field of normative practice and an object of comparative study. Where the national-centric models see local government as a matter belonging to policy on decentralization for later in the reconstruction phase, the book uncovers a distinct "local government dimension" to peace transitions: A civic dimension to national conflicts that must be explained; incipient or proto-local authorities that emerge even during civil war, in peace making, after state collapse; the fact that it is common for peace agreements and constitutions to include rules for local authority, for local elections to be held as part of broader democratization, and for laws to be enacted to establish local government as part of peace compacts. The book develops the concept of local peace transition to explain the distinctive constitutive role of this local dimension in peace-making and state formation. This path-breaking book will be of compelling interest to practitioners, scholars and students of comparative constitutional studies, international law, peace building and state building.
