Book excerpt: This report by the Quadripartite Committee (the Defence, Foreign Affairs, International Development and Trade & Industry Select Committees) examines the Government's licensing decisions on strategic exports taken during 2002 and 2003. This includes military equipment, such as guns, tanks and missiles, other non-lethal military and police equipment such as anti-riot shields, de-mining devices and chemical weapon detection systems; as well as civilian goods and technology which has a potential military application (dual-use) such as chemical products, cryptographic software and space satellites. Issues discussed include the transparency of Government information provision; monitoring of end-use assurances; the EU Code of Conduct on Arms Exports and EU enlargement; international arrangements for export controls; the complexity of the British export control system compared to other European countries; enforcement and prosecution of export control breaches by HM Customs & Excise. The Committee's report finds that export controls are a crucial part of efforts to limit the proliferation of weapons and military technology, from small arms to biological agents, but in order to be effective these need to be applied internationally. More information should be published about the end use of equipment and technology exported, for example to Indonesia, to ensure adequate scrutiny and accountability in the granting of export licenses.

Available in PDF, EPUB and Kindle. Book excerpt: The Committee on Strategic Export Controls (known as the Quadripartite Committee) is made up of members of the Defence, Foreign Affairs, International Development and Trade and Industry Committees. It began regular scrutiny of the Government's policy on the export control system in 1999, and this report includes a detailed examination of the operation and enforcement of strategic export controls run by the Export Control Organisation and HM Revenue & Customs. It also considers issues raised by particular licences, including whether the policy on licence approvals or refusals is consistent and determined in accordance with the EU Code of Conduct on Arms Exports and the National Export Licensing Criteria. The Committee held five evidence sessions in the course of its inquiry, including evidence from officials from the DTI and FCO, HMRC and the Revenue and Customs Prosecution Office, members of the Export Group on Aerospace and Defence (EGAD) and the UK Working Group on Arms, as well as from Mark Thomas, broadcaster and journalist. Amongst the Committee's 83 conclusions and recommendations, the report raises concerns about the loopholes in regulations relating to internet arms sales and to arms fairs, as well as 'dual-use' equipment (that could have both a civilian and a military purpose). It also calls for greater clarity in the policy on arms sales to Saudi Arabia and Israel, given human rights concerns; and it argues that the arms embargo on China should remain and that the Government should work with the EU and the United States to ensure the embargo remains effective. The report also raises concerns about the reporting and status of strategic export controls to and from the Channel Islands, given that they are not subject to the Export Control Act 2002; and recommends that the Export Control Organisation should remain within the public sector under government control. The report notes that the Government's review of arms control rules scheduled for 2007 provides a timely opportunity to take stock of developments in the UK's export control system since the Scott Inquiry into exports to Iraq in 1996, and in light of the challenge of increased globalisation of the defence industry, and that it will also be a critical year for progress on the International Arms Trade Treaty.

Book excerpt: This is the fifth report of the quadripartite committee that examines the Government's policy on strategic export controls. It examines the changes since the last report and welcomes several Government initiatives, in particular the publication of quarterly data. It notes that the new system introduced by the Export Control Act of 2002 seems to be working well but calls for the extra-territorial controls to be extended. In the international arena the Committee recommend that the Government should oppose the lifting of the arms embargo on China.

Book Strategic export controls

Download or read book Strategic export controls written by Great Britain: Parliament: House of Commons: Defence Committee and published by The Stationery Office. This book was released on 2007-08-07 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Government published a consultation document "Export Control Act 2002: 2007 review of export control legislation" in June 2007 (further details can be accessed at http://www.berr.gov.uk/consultations/page39910.html). This report contains the Quadripartite Committee's own review of export control legislation, along with its response to the Government's consultation document. The Committee concludes that the Export Control Act 2002 has provided a sound legislative basis for controlling and regulating the UK's strategic exports but with gaps and shortcomings. It also welcomes the Government's review as a constructive process that addresses many of the issues the Committee and other parties have raised over several years, and praises the improvement in the volume and quantity of information that the Government provides. But the review does not mention HM Revenue and Customs, the department that enforces the controls; and it ignores the EU dimension despite a significant part of the export control regime being derived from EU legislation. The Committee makes nearly 100 recommendations and observations on the review and the operation and effectiveness of the UK export control legislation.

Book Scrutiny of arms export controls 2012

Download or read book Scrutiny of arms export controls 2012 written by Great Britain: Parliament: House of Commons: Business, Innovation and Skills Committee and published by The Stationery Office. This book was released on 2012-07-13 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Committees on Arms Export Controls (CAEC) believe that the Government should apply significantly more cautious judgements on the export of arms to authoritarian regimes which might be used for internal repression. The Committees have scrutinised in unprecedented detail the Government's latest (2010) Annual Report on Strategic Export Controls (HC 1402, session 2011-12, ISBN 9780102973662), the Government's quarterly information on individual export licence approvals and refusals, and the Government's policies and performance on arms export controls and on arms control generally. The Committees conclude that the Government's review of its policies and practices on arms exports following the Arab Spring should not have been carried out merely as "an internal review" and should instead have been the subject of public consultation in accordance with the Government's stated policy of transparency on arms exports. And whilst the Government's introduction of a new licence suspension mechanism is welcome, this is not sufficient to ensure that arms exported are not used for internal repression overseas because in many cases the arms will have left the UK before suspension occurs. The Government should extend its arms export policy review from countries in the Middle East and North Africa to authoritarian regimes and countries of human rights concern worldwide. Annex 7 of the report gives selected arms export licence approvals by the Government to countries of human rights concern, and the report also contains details of the extant UK Government approved arms export licences to Argentina, Bahrain, Egypt, Libya, Saudi Arabia, Syria, Tunisia and Yemen.

This book was released on 2004 with total page 68 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Committee's findings include that the Smart Acquisition procurement programme, introduced by the Ministry of Defence (MoD) in 1998, has failed to deliver on almost all counts. In 2002-03, the top 20 defence equipment projects experienced in-year cost increases totalling £3.1 billion, as well as time delays on promised delivery dates. The head of the Defence Procurement Agency has found that only one of the seven principles underlying Smart Acquisition has been implemented in full, and a fundamental overhaul of the initiative has been announced. On specific projects, the Committee's findings include that the in-service date for Eurofighter/Typhoon was achieved during 2003, a total of 54 months late; and an assessment phase contract for the Future Rapid Effect System (FRES) is to be placed at the end of the year, although there are concerns that the in-service date of 2009 is unrealistic.

Book Controlling the Weapons of War

Available in PDF, EPUB and Kindle. Book excerpt: A fresh examination of the ethical and intellectual issues and dilemmas associated with attempts to establish formal humanitarian limits on weaponry. This new study considers how governments, non-governmental organizations, academics, political commentators and others have responded to the predicaments associated with imposing classifications about the relative acceptability of force and what is accomplished in their strategies for doing so. It develops these issues through combining thematic and conceptual analysis with the examination of varied cases of prohibitions on ‘conventional’ and ‘unconventional’ weapons through customary and statutory laws, multilateral treaties, UN resolutions, and national legislation. The book will appeal to students of security studies, military technology, peace studies, international relations and discourse theory.
