Book excerpt: Public life in Great Britain underwent a major transformation after the repeal of the Test and Corporation Acts in 1828 and the passage of the Catholic Relief Act of 1829, which eliminated the requirement that men in public positions swear to uphold the doctrines of the Anglican Church. According to Lubenow (Stockton College), these legislative changes initiated a fundamental reallocation of power, opening many careers to men of talent and educational qualifications, including those whose perspectives and intellectual dispositions led them to question the validity of uniform religious dogma. Lubenow identifies members of the Benson, Strachey, Balfour, Lyttelton, and Sitwell families among the "Men of Letters" who epitomized the 19th century's new secular meritocracy, noting that when religious uniformity was removed as a requirement for positions in the public sphere, religion became more important, if more fluid, in the lives of such Britons. Thus, men of intellectual merit, rather than only those from the more conservative landowning or military traditions, were able to rise in politics, civil service, the clergy, the professions, and the universities, taking their liberal values regarding liberty, moral cultivation, and philosophy into the wider public sphere. A man who has no legal rights against another, but stands entirely at his disposal, to be treated according to his caprice, is a slave to that other. He is "rightless," devoid of rights. Now, in some barbaric monarchies the system of rightlessness has at times been consistently carried through in the relations of subjects to the king. Here men and women, though enjoying customary rights of person and property as against one another, have no rights at all as against the king's pleasure. No European monarch or seignior has ever admittedly enjoyed power of this kind, but European governments have at various times and in various directions exercised or claimed powers no less arbitrary in principle. Thus, by the side of the regular courts of law which prescribe specific penalties for defined offences proved against a man by a regular form of trial, arbitrary governments resort to various extrajudicial forms of arrest, detention, and punishment, depending on their own will and pleasure. Of such a character is punishment by "administrative" process in Russia at the present day; imprisonment by lettre de cachet in France under the ancien r�gime; all executions by so-called martial law in times of rebellion, and the suspension of various ordinary guarantees of immediate and fair trial in Ireland."Leonard Trelawny Hobhouse was a British liberal political theorist and sociologist, who has been considered one of the leading and earliest proponents of social liberalism.
