Book Improving Democracy Through Constitutional Reform

Download or read book Improving Democracy Through Constitutional Reform written by Roger D. Congleton and published by Springer Science & Business Media. This book was released on 2003-04-30 with total page 258 pages. Available in PDF, EPUB and Kindle. Book excerpt: Do constitutions matter? Are constitutions simply symbols of the political times at which they were adopted, or do they systematically affect the course of public policy? Are the policy crises of failing democracies the result of bad luck or of fundamental problems associated with the major and minor constitutional reforms adopted during their recent histories? The purpose of the present study is to address these questions using a blend of theory, history, and statistical analysis. The Swedish experience provides a nearly perfect laboratory in which to study the effects of constitutional reform. During the past 200 years, Swedish governance has shifted from a king-dominated system with an unelected four-chamber parliament to a bicameral legislature elected with wealth-weighted voting in 1866, and then to a new electoral system based on proportional representation and universal suffrage in 1920, and finally to a unicameral parliamentary system in 1970. All these radical reorganizations of Swedish governance were accomplished peacefully using formal amendment procedures established by previous constitutions. By focusing on constitutional issues rather than Sweden's political history, this book extends our understanding of constitutional reform and parliamentary democracy in general.

Book American Constitutional History

Download or read book American Constitutional History written by Jack Fruchtman and published by John Wiley & Sons. This book was released on 2022-01-12 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: Reveals how the Constitution has evolved over the past 235 years, featuring updated coverage of the 2020 presidential election and constitutional changes made by the Supreme Court up to June 2021 American Constitutional History: A Brief Introduction, Second Edition presents a concise and accessible history of the 235-year development of the Constitution since its ratification. The book is organized around five distinct periods in U.S. history—the New Republic, the Slave Republic, the Free-Market Republic, the Social Welfare Republic, and the Contemporary Republic—to demonstrate the evolution of the American republic and its founding document over time. With an engaging narrative approach, author Jack Fruchtman describes how constitutional changes have occurred through both formal amendments and informal decisions by the president, Congress, and the Supreme Court. Updated to cover the period from 2015 to 2021, the second edition examines the controversial presidential election of 2020 in which Donald Trump, despite losing the electoral and popular vote, claimed victory and espoused charges of widespread election fraud. New coverage of the addition of Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett to the Supreme Court is complemented by discussion of important decisions made after 2015, including affirming same-sex marriage, a woman's right to abortion under certain circumstances, the right to own and carry a firearm, and the central place of religious liberty in American society. This book also: Highlights the Constitution's evolution through government regulation of the economy, individual and civil rights, and executive power Reflects the evolution of constitutional changes made by the Supreme Court up to June 2021 Discusses topics such as the ideological origins of the U.S Constitution, the Civil War and Reconstruction, the civil rights movement, and growth of executive power Includes chapter overviews, summaries, and descriptions of formal constitutional amendments ratified by the states American Constitutional History: A Brief Introduction, Second Edition is an excellent introductory textbook for upper-level undergraduate and graduate courses in American history and political science and a must-read for general readers seeking insights into the origins and evolution of the U.S. Constitution.

Book Methods of Constitutional Reform

Download or read book Methods of Constitutional Reform written by Emeritus Professor of Music George Pratt and published by Forgotten Books. This book was released on 2018-02-02 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Methods of Constitutional Reform: With Reasons Why No Constitutional Convention Should Be Called by the General Assembly The act of calling a constitutional convention would show that a majority of the House of Representatives deemed it necessary to alter or amend the constitution. For, if they did not deem it necessary, they would take no steps to call a convention. But the constitution says, that when they deem it necessary to alter or amend the constitution they shall act in the method pointed out in the instrument. Can they act in another manner and not violate the constitution? About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book The Constitutional History of New York Vol 1 of 5

Download or read book The Constitutional History of New York Vol 1 of 5 written by Charles Z. Lincoln and published by Forgotten Books. This book was released on 2017-09-18 with total page 774 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Constitutional History of New York, Vol. 1 of 5: From the Beginning of the Colonial Period to the Year 1905 Showing the Origin, Development, and Judicial Construction of the Constitution; 1609-1822 After the larger part of the book had been written, I found, in the Albany Argus, a sentiment which closely accords with my own view of the proper scope of a gen eral work on history. This writer says that history is most useful and most intelligible when it shows accurate ly the course of events, the motives underlying them, and the people who shaped them. I have tried to apply this rule in the present work, - to state every fact with all possible accuracy, to discover the motive and purpose of each proposed constitutional reform, and to present a view of the men who shaped the Constitution, so far as this was practicable from reported Speeches and other documents purporting to contain a statement of their opinions and intentions. Book The Architecture of Constitutional Amendments

Download or read book The Architecture of Constitutional Amendments written by Richard Albert and published by Bloomsbury Publishing. This book was released on 2023-05-18 with total page 277 pages. Available in PDF, EPUB and Kindle. Book excerpt: This innovative book blends constitutional theory with real-life political practice to explore the impact of codifying constitutional amendments on the operation of the constitution in relation to democracy, the rule of law, and the separation of powers. It draws from comparative, historical, political and theoretical perspectives to answer questions all constitutional designers should ask themselves: - Should the constitution append amendments sequentially to the end of the text? - Should it embed amendments directly into the existing text, with notations about what has been modified and how? - Should it instead insert amendments into the text without indicating at all that any alteration has occurred? The book examines the 3 major models of amendment codification – the appendative, the integrative, and the invisible models – and also shows how some jurisdictions have innovated alternative forms of amendment codification that combine elements of more than 1 model in a unique hybridisation driven by history, law, and politics. Constitutional designers rarely consider where in the constitution to codify amendments once they are ratified. Yet this choice is pivotal to the operation of any constitution. This groundbreaking book shows why the placement of constitutional amendments goes well beyond mere aesthetics. It influences how and whether a people remembers its past, how the constitutional text will be interpreted and by whom, and whether the constitution will be easily accessible to the governed. A global tour of the high stakes of constitution-making, this book features 18 diverse and outstanding scholars from around the world – across Africa, America, Asia and Oceania, and Europe – raising new questions, opening our eyes to new streams of research, and uncovering new possibilities for constitutional design.
