Na een toelichting over de mogelijkheden en beperkingen van het DNA-onderzoek ontleedt de auteur nauwkeurig de voorschriften inzake volgende thema’s: de opname van celmateriaal, bewaring en ontleding van sporen, de kwaliteitsnormen van laboratoria, de afname van celmateriaal van verdachten en de opslag van DNA-profielen in databestanden. De auteur interpreteert niet enkel de teksten, maar biedt de lezer ook inzicht in een aantal praktische problemen, en biedt tevens oplossingen aan om leemtes in de wet en het uitvoeringsbesluit op te vullen. In het tweede deel wordt nagegaan of de DNA-wet verenigbaar is met fundamentele grondrechten, zoals de rechten van de verdediging, het recht op bescherming van de fysieke integriteit en het recht op privacy. Centraal staat de vraag of de DNA-wet voldoende kwaliteitseisen aan deskundigen oplegt en of gegevens die de privacy raken juist en omzichtig worden benut. Het geheel wordt afgesloten met kanttekeningen over de bewijswaarde van het DNA-onderzoek en met enkele kritische beschouwingen over de DNA-wet.

Uit eerder onderzoek blijkt dat rechters en andere procesdeelnemers moeite hebben om DNA-bewijs te begrijpen en op juiste wijze te interpreteren. In dit boek wordt verslag gedaan van een onderzoek naar de kwaliteit van rechterlijke uitspraken ten aanzien van de waardering van DNA-mengprofielen. De auteur besteedt eerst uitgebreid aandacht aan het juridisch kader, de wijze waarop DNA-bewijs in strafzaken wordt gepresenteerd en de verschillende fouten die bij de waardering hiervan kunnen worden gemaakt. Op basis van het uitgevoerde jurisprudentieonderzoek wordt vervolgens geconcludeerd dat de waardering van DNA-bewijs te wensen overlaat, ondanks de reeds genomen initiatieven ter verbetering van deskundigenrapportages en het begrip hiervan. In 55 van de 78 uitspraken die in dit onderzoek zijn bekeken, worden namelijk onduidelijkheden, vaagheden en/of denkfouten in de bewijsoverwegingen aangetroffen. De auteur gaat in op de vraag op welke wijze de resultaten van dit onderzoek geïnterpreteerd mogen worden en doet een aantal aanbevelingen ter verbetering van de waardering van DNA-bewijs.0.

Biometric systems use facial images, fingerprints, iris and/or voice in an automated way to identify or to verify (identity) claims of persons. It continues with a description of the legal nature of biometric data and makes a comparison with DNA and biological material and the regulation thereof. After describing the risks, the work further reviews the opinions of data protection authorities in relation to biometric systems and current and future (EU) law. The author concludes with an evaluation of the proportionality principle and the application of data protection law to biometric data processing operations, mainly in the private sector.
