Book excerpt: This is a reprint of Anthony Ogus' classic study of regulation, first published in the 1990s. It examines how, since the last decades of the twentieth century there have been fundamental changes in the relationship between the state and industry. With the aid of economic theory Anthony Ogus critically examines the ways in which public law has been adapted to the task of regulating industrial activity and provides a systematic overview of the theory and forms of social and economic regulation. In particular, he explores the reasons why governments regulate, for which, broadly speaking, two theoretical frameworks exist. First 'public interest' theories determine that regulation should aim to improve social and economic welfare. Second, 'economic' theories suggest that regulation should aim to satisfy the demands of private interests. The book also looks at the evolution of the forms of regulation in Britain, extending to the policies of privatization and deregulation which were so characteristic of the period. The author skilfully evaluates the advantages and disadvantages of the different forms of regulation, particularly in the light of the two theoretical frameworks, but also by involving an analysis of how firms respond to the various kinds of incentives and controls offered by government. A significant feature of the book is its analysis of the choices made by governments between the different forms of regulation and the influence exerted by interest groups (including bureaucrats) and EC law.

Book Abortion in the United States Judicial History and Legislative Battle

Download or read book Abortion in the United States Judicial History and Legislative Battle written by Various Authors and published by Good Press. This book was released on 2023-12-26 with total page 391 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edition represents history of the battle for women's rights, the complexity of the legislative process, the study on all abortion regulations and the recent controversial ruling in the United States. The goal of this book is to help people understand the judicial complexity that led to the revolutionary Roe v. Wade legislation and the most recent controversial ruling, to show the hard battle that was fought before and the struggle that lays ahead for both parties. The legality of abortion in the United States is subject to individual state laws. In 1973, Roe v. Wade made the first abortion case to be taken to the Supreme Court, which had made it federally legal. In 1992, Roe was partially overturned by Planned Parenthood v. Casey, which stated that states cannot place legal restrictions posing an undue burden for "the purpose or effect of placing a substantial obstacle in the path of a woman seeking an abortion of a nonviable fetus." In 2022, both Roe and Casey were overturned, and abortions are now subject to regulations based on state laws once again. Individual states can regulate and limit the use of abortion, some of which already have through the use of "trigger laws", which made abortion illegal within the first and second trimesters when Roe was overturned. Eight states—Alabama, Arizona, Arkansas, Michigan, Mississippi, Oklahoma, West Virginia and Wisconsin—still have pre-Roe abortion bans in their laws, which may be enforced too. This reading provides a thorough overview of the federal legalisation regarding the legality of abor-tion. It presents a judicial history and legislative response of the US federal institutions. In addition this collection is enriched with information which are indispensable part of every abortion debate in the United States. Contents Abortion: Judicial History and Legislative Response Abortion At or Over 20 Weeks' Gestation (FAQ) Revolutionary Ruling: Roe v. Wade Doe v. Bolton Planned Parenthood v. Casey Women's Health Protection Act 2022 Ruling: Dobbs v. Jackson Women's Health Organization

Available in PDF, EPUB and Kindle. Book excerpt: The goal of this edition is to help people understand the complexity of the issue, to learn about the long battle that was fought before the revolutionary ruling Roe v. Wade and the slow success of the numerous legislations and regulations passed after this law which led to the most recent controversial ruling. Book Patient Safety Law Policy and Practice

Download or read book Patient Safety Law Policy and Practice written by John Tingle and published by Routledge. This book was released on 2011-03-02 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: Patient safety is an issue which in recent years has grown to prominence in a number of countries’ political and health service agendas. The World Health Organisation has launched the World Alliance for Patient Safety. Millions of patients, according to the Alliance, endure prolonged ill-health, disability and death caused by unreliable practices, services, and poor health care environments. At any given time 1.4 million people worldwide are suffering from an infection acquired in a health facility. Patient Safety, Law Policy and Practice explores the impact of legal systems on patient safety initiatives. It asks whether legal systems are being used in appropriate ways to support state and local managerial systems in developing patient safety procedures, and what alternative approaches can and should be utilized. The chapters in this collection explore the patient safety managerial structures that exist in countries where there is a developed patient safety infrastructure and culture. The legal structures of these countries are explored and related to major in-country patient safety issues such as consent to treatment protocols and guidelines, complaint handling, adverse incident reporting systems, and civil litigation systems, in order to draw comparisons and conclusions on patient safety.
