Book Mastering Negotiable Instruments UCC Articles 3 and 4 and Other Payment Systems

Download or read book Mastering Negotiable Instruments UCC Articles 3 and 4 and Other Payment Systems written by Michael D. Floyd and published by . This book was released on 2008 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: Mastering Negotiable Instruments (UCC Articles 3 and 4) and Other Payment Systems explains the essential concepts in the law governing payment systems. The book focuses primarily on the prototypical payment systems that for centuries have used negotiable instruments: notes, checks, and other types of drafts. It explores the rules and mechanisms that regulate transactions in negotiable instruments from issue to collection. Study of the rules starts with UCC Article 3 (governing negotiable instruments generally) and Article 4 (governing check collection), but also requires consideration of federal statutes such as the Expedited Funds Availability Act, the new Check Clearing for the 21st Century Act, and related federal regulations. The book also explores the largely federal law governing newer payment systems that have evolved from negotiable instruments, such as credit cards and debit cards. "I am a 2L at Rutgers School of Law and this has been an invaluable guide as I prepare for my Intro to UCC final exam. After reading numerous outlines and guides, this has been the most straightforward and concise book I have ever read. Thank you again for an excellent, well laid out guide." -- Josh Bandes "Over the years, I have practiced in the bankruptcy and commercial litigation areas. In late 2009, I decided to become involved in foreclosure defense work. It soon became apparent that I needed a refresher course in Articles 3 and 4 of the UCC. I was lucky to find Professor Floyd's book entitled, 'Mastering Negotiable Instruments' published by Carolina Academic Press. Professor Floyd's treatment of the subject matter is thorough, but at the same time, readable and understandable. Each chapter begins with a roadmap of subjects to be discussed and ends with a checklist which summarizes the main points. I still refer to the book frequently to confirm my research. After reading the book, I may not have been ready to teach a course on negotiable instruments, but I was certainly able to hold my own in court." -- Kevin Hanly, Esq.

Book Hand Book of the Law of Bills and Notes Classic Reprint

Download or read book Hand Book of the Law of Bills and Notes Classic Reprint written by Charles P. Norton and published by . This book was released on 2016-06-27 with total page 608 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Hand-Book of the Law of Bills and Notes In preparing a new edition of Mr. Norton's book, it has been deemed advisable to print as an appendix the Negotiable Instruments Law, which has already been adopted in fifteen states, as well as in the Dis triet of Columbia. It is obvious that even an elementary book upon Bills and Notes must contain references to this law, which, while it is, in the main, declaratory in its efiect, settles some doubtful points, and necessarily changes rules in many jurisdictions upon points con cerning which a conflict of laws existed. The text of the law as print ed in the appendix is that of the New York act, such few modifications as have been made by the various states being mentioned in the notes. The law is also valuable to the student, even in states which have not adopted it, as furnishing a concise statement of rules, which for the most part are of universal application; and for this reason the editor has throughout the book, in the footnotes, inserted references to the appropriate sections of the law, at the same time pointing out any changes effected by them. Much new matter has been incorpo rated, and this has necessitated some alteration of the former text. At the suggestion of many teachers, the publishers have adopted the device of printing in bold type in the footnotes and text the names of all cases there cited which are to be found in certain of the collee tions of leading and illustrative cases on Bills and Notes in use in the law schools. The cases so printed are to be found in Ames' Cases on the Law of Bills and Notes, Huffcut's Negotiable Instruments, and Johnson's Elements of the Law of Negotiable Contracts (second edi tion). The present editor wishes to express his great obligation to Prof. Ames, whose Index and Summary at the end of the cases, unquestion ably the most important contribution to the subject that has been made in America, he has constantly consulted; and to Prof. Hufl'cut, whose Negotiable Instruments is an invaluable commentary upon the Negotiable Instruments Law.
