Book Guide to Courts Martial Duty Classic Reprint

Download or read book Guide to Courts Martial Duty Classic Reprint written by Thomas King and published by Forgotten Books. This book was released on 2018-03-07 with total page 44 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Guide to Courts Martial Duty MY object in writing this book is to assist officers in conducting the proceedings of courts martial. I have given details as to the Prosecutor and President regarding the various courts, and it is very essential that the facilities and privileges that the accused is entitled to, both before the assembly of the Court and during the trial, should be understood by all officers. I have confined myself to the procedure of courts martial only. As regards the various offences, see the Army Act sections 4 - 41 Manual of Military Law, pages 371, 372 and 378 - 413. Chapter V of the Manual of Military Law should be read, pages 35 - 54, and the Rules of Procedure, Manual of Military Law, pages 571 - 642. It is advisable, when the Court is sitting, to keep the memoranda before the Court as laid down in the Manual of Military Law, page 703 and when determining the sentence King's Regulations para 583 (xi) may be referred to with advantage. Book A Treatise on Military Law and the Practice of Courts Martial Classic Reprint

Download or read book A Treatise on Military Law and the Practice of Courts Martial Classic Reprint written by S. V. Benét and published by Forgotten Books. This book was released on 2017-10-25 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on Military Law and the Practice of Courts-Martial Within the past few years, more has been done to fix disputed and doubtful points in the practice Of our military tribunals, than during any former period in our military history. F or this progressive movement, we are mainly indebted to the able decisions, while reviewing the proceedings Of courts-martial, that have issued from the War Department since the establish ment of the office of Judge Advocate of the Army and to the many elaborate Opinions by the Attorneys General, on points of law requiring legal interpretation. These decisions and opiu ions, presenting, as they do, authoritative information of nu usual interest to the army at large and not generally accessible, first suggested the preparation of a work in which they might be embodied. The suggestion lost none of its force, in view Of the fact, that for the instruction of the Cadets of the Military Academy in the practice of courts-martial, this most essential information was not to be found in their text-book. This volume has been the result of much careful investiga tion, and the hope is entertained that it may contribute a use ful link in the chain of our military jurisprudence. TO the Judge Advocate Of the Army, I am indebted, for furnishing me the information I had occasion to seek in the records of the War Department. Book excerpt: Motions shape the battlefield of courtroom practice. Whether providing advanced knowledge of the admissibility of alleged prior bad acts by a client or seeking a ruling on a proposed panel instruction, motions in military practice are instrumental in preparing for the war of a court-martial trial. Failing to approach motions practice as a pivotal step in shaping the battlefield for the war of a court-martial trial does a disservice to one's client. This book dares you to step away from the "shared drive" and instead to take a fresh approach with each motion for every case. I have dissected my own process and am providing the insight that I derived for your benefit in the form of this book. My law firm's mantra is that we want to be where we can do the most good. My goal for this book is the same: to elevate the practice. One motion at a time.
