Il testo si rivolge a Pubbliche Amministrazioni, Enti, imprese e operatori del settore e intende offrire un panorama completo delle competenze, adempimenti, procedure, responsabilità con riguardo alle principali autorizzazioni ambientali. Accanto all’Autorizzazione integrata ambientale (AIA), volta a superare un approccio settoriale rispetto alla soluzione dei fenomeni di inquinamento, e all’Autorizzazione unica ambientale (AUA), espressione dell’esigenza di semplificazione procedimentale alla quale tende l’ordinamento amministrativo, si è ritenuto di analizzare il complesso tema delle autorizzazioni degli impianti per l’energia rinnovabile, di particolare attualità a fronte dell’urgenza di incentivare la transizione verso fonti energetiche non soggette a esaurimento e con un limitato impatto ambientale. Scopo dell’eBook è non solo quello di fornire al lettore elementi per la comprensione delle questioni tecnico-giuridiche inerenti alle autorizzazioni ambientali, ma anche di rappresentare uno strumento di agevole consultazione per gli operatori del settore in relazione alle problematiche che possono emergere nella concreta applicazione degli istituti oggetto di indagine. Adeguato spazio è stato quindi riservato alla trattazione del regime sanzionatorio come disciplinato dal D.Lgs. n. 152/2006 e dal Codice penale, individuando le conseguenze dell’inosservanza delle disposizioni normative relative alla tutela dell’ambiente, mentre il capitolo conclusivo si incentra sulla responsabilità amministrativa degli Enti derivante dalla commissione di illeciti penali a norma del D.Lgs. n. 231/2001, dedicando attenzione all’attività di controllo in materia di autorizzazioni ambientali e alle buone pratiche.

Book excerpt: Il 13/06/2013 è entrato in vigore il D.P.R. 13 marzo 2013, n. 59 “Regolamento recante la disciplina dell’autorizzazione unica ambientale e la semplificazione di adempimenti amministrativi in materia ambientale gravanti sulle piccole e medie imprese e sugli impianti non soggetti ad autorizzazione integrata ambientale” L’Autorizzazione Unica Ambientale (A.U.A.) è stata prevista dal legislatore quale risposta alla richiesta delle imprese di semplificare i procedimenti afferenti ad una molteplicità di autorizzazioni e comunicazioni previste dalle leggi in materia ambientale. Nel presente volume viene esplicitata la nuova normativa di semplificazione (nel Capitolo terzo), ma poiché si tratta di norma esclusivamente procedurale si è ritenuto opportuno descrivere nel Capitolo 1 tutti i procedimenti autorizzatori che vengono assorbiti dall’A.U.A. poiché le discipline di merito afferenti a tali autorizzazioni sono tuttora contenute nelle varie normative di settore. Si è poi ritenuto opportuno inserire nel volume l’esplicitazione dell’altra norma già vigente da alcuni anni, che assorbe le varie autorizzazioni ambientali, cioè quella afferente all’Autorizzazione Integrata Ambientale (contenuta ora nel d.lgs. n. 152 del 2006 e ss.mm.), a cui è dedicato il Capitolo 2, evidenziandone anche le diversità rispetto alla disciplina dell’A.U.A. Bernardino Albertazzi, giurista ambientale è docente sulla normativa ambientale dell’Unione Province Italiane, dell’ARPA Emilia-Romagna e Liguria, di Confservizi Lombardia e collabora con varie università tra le quali quella di Brescia,la Bocconie il Politecnico di Milano. Relatore in convegni nazionali e internazionali, è autore di numerose pubblicazioni ed è stato direttore di redazione delle riviste “Rifiuti solidi” e “Ingegneria ambientale” (CIPA Editore). The European Union specifies this principle in EC directives on integrated pollution prevention and control (IPPC), on environmental impact assessment (EIA), and on the control of major accident hazards involving dangerous substances (Seveso II). This is the first book to investigate from both empirical and normative perspectives the effectiveness of these directives at the national level. It provides by far the most extensive comparative analysis and evaluation of the industrial permitting and inspections, EIA, and major accident prevention in the EU. Offering an in-depth study of the transposition and implementation of EC environmental directives in eight EU member states (Denmark, France, Germany, Italy, the Netherlands, Spain, Sweden, and the United Kingdom), the author who has played a significant role in the formulation of environmental legislation and regulation at both the national (German) and EU levelsand¿provides a stable base for an assessment of the benefits and costs of the integrated approach to environmental protection. Among the factors considered are the following: key features of national constitutional, administraand¬tive, and judicial systems which provide the framework for environand¬mental regulations and their implementation in the eight countries under study; procedures and substantive requirements transposing the IPPC, EIA and Seveso II directives into national laws; and evaluation of national deficiencies and the extent of muddling through. The empirical part of Dr Bohne's analysis draws on 138 expert interviews with public and private actors, a survey of 178 public authorities, and document analyses of selected industrial permits and environmental impact statements. His comparative analysis of procedural, organizational, and substantive integration makes it possible to identify and compare national accomplishments in regulatory integration, and offers new insights into the effectiveness and limits of EC law. The study concludes with a discussion of the implications of the findings for European governance and better regulation after the enlargement of the EU. This thoroughly researched, rigorous, and insightful study will be of great interest and value to policymakers, regulators, business people, environmental NGOs, consultants, and lawyers, as well as to students of environmental policies and European governance.

If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

Book excerpt: The recent development of ideas on biodiversity conservation was already being considered almost three-quarters of a century ago for crop plants and the wild species related to them, by the Russian geneticist N.!. Vavilov. He was undoubtedly the first scientist to understand the impor tance for humankind of conserving for utilization the genetic diversity of our ancient crop plants and their wild relatives from their centres of diversity. His collections showed various traits of adaptation to environ mental extremes and biotypes of crop diseases and pests which were unknown to most plant breeders in the first quarter of the twentieth cen tury. Later, in the 1940s-1960s scientists began to realize that the pool of genetic diversity known to Vavilov and his colleagues was beginning to disappear. Through the replacement of the old, primitive and highly diverse land races by uniform modem varieties created by plant breed ers, the crop gene pool was being eroded. The genetic diversity of wild species was equally being threatened by human activities: over-exploita tion, habitat destruction or fragmentation, competition resulting from the introduction of alien species or varieties, changes and intensification of land use, environmental pollution and possible climate change.
