Book excerpt: The Goldwater-Nicholas Reorganization Act of 1986 was the most sweeping legislation related to DOD reform since the enabling legislation following World War II. Its de jure purpose, inter alia, was to enhance the legal authority of the Chairman of the Joint Chiefs and the unified commanders. Its practical purpose was to improve U.S. warfighting capability. As one might expect, implementation has been controversial in terms of shifting power from the Services to the Joint Staff and the CINCs, particularly as interpreted by the Joint Staff. It is worth noting the Joint Staff remained an organization which assists the Chairman of the Joint Chiefs vice transitioning to a general staff. Many point to the warfighting success of Desert Shield/Desert Storm as conclusive proof that Goldwater-Nicholas achieved its purpose. However, DOD is now entering a period of unsettled reshuffling of budget priorities as Congress and the President struggle with balancing the U.S. budget. This will undoubtedly mean far fewer resources, both dollars and people, for DOD as a whole. Goldwater-Nicholas was enacted under implicit assumptions about strategic threats and organizational needs of the U.S. military (e.g., the Soviet Union was still a viable political entity in 1986). This paper explores whether Goldwater-Nicholas went far enough in its reform efforts, particularly considering the increasing importance of military operations other than war and the inevitable pressures to further reduce the military budget. It focuses on relationships and divisions of labor between the Joint, Service, and CINC staffs.

This act resulted from frustration in Congress and among certain military officers concerning what they believed to be the poor quality of military advice available to civilian decision-makers. It also derived from the U.S. military's perceived inability to conduct successful joint or multi-service operations. The act, passes after four years of legislative debate, designated the Chairman of the Joint Chiefs of Staff as the principal military advisor to the President and sought to foster greater cooperation among the military services. Goldwater-Nichols marks the latest attempt to balance competing tendencies within the Department of Defense, namely centralization versus decentralization and geographic versus functional distributions of power. As a result of the Goldwater-Nichols Act, the Chairman of the Joint Chiefs has achieved prominence, but his assignment is somewhat contradictory: the spokesman and thus the advocate for the Commander in Chief, while simultaneously the provider of objective advice to the President. While the act did succeed in strengthening the CINCs' authority and in contributing to the dramatic U.S. achievements in the Gulf War, the air and ground campaigns revealed weaknesses in the CINCs' capability to plan joint operations. In addition, the increased role of the military in ad hoc peacekeeping operations has challenged the U.S. military's current organizational structure for the quick deployment of troops from the various services. Rapid technological advances and post-Cold War strategic uncertainty also complicate the U.S. military's organizational structure.

Book excerpt: On 1 October, 1986, President Ronald Reagan signed into law the Defense Reorganization Act of 1986, otherwise known as the Goldwater-Nichols Act It was the culmination of a four-year debate, from the disclosure of significant problems with the Joint Chiefs of Staff (JCS) system by then-chairman General David Jones, USAF, to the final conference bill that became law. Throughout the process, the Navy Department (Navy and Marines), under the leadership of Secretary John Lehman, led the effort to defeat the bill. Though the Navy has come onboard with Goldwater-Nichols faster and to a greater extent than any of the other services, many of the arguments articulated by Lehman and his cohorts remain of concern. They have not been satisfactorily answered, and bear detailed analysis and debate. Based on numerous interviews with key officials, this essay reviews the inside politics of the Goldwater-Nichols Act, then summarizes the Navy's arguments against it. A brief assessment is then provided to look at Navy's arguments in light of the effort of the defense organization to implement the main provisions of the act Finally, some concluding remarks outline serious questions about the course we are on in defense organization, and the implications of that course for the country. Constrained in both space and time, the purpose of this paper is limited to an outline of the events, and to the encouragement of a frank, open and rigorous debate on the direction we are headed Complacency is to be avoided; intelligent discourse, sometimes critical, sometimes not, is to be welcomed as a strengthening and constructive element. If that discourse is ever strangled because of dogmatism, rigidity, or centralization, then great concern will be fitting, but, perhaps, also too late.

Book excerpt: Thirty years after its enactment, Congress has undertaken a review of the Goldwater-Nichols Department of Defense Reorganization Act (GNA) as well as the broader organisation and structure of the contemporary Department of Defense (DOD) more broadly. Most observers agree that in principle a comprehensive review of the Goldwater-Nichols legislation is warranted at this juncture. Further, a broad consensus appears to exist among observers that DOD must become considerably more agile while retaining its strength in order to enable the United States to meet a variety of critical emerging national security challenges. Agreement seemingly ends there. There appears to be little consensus on what should be changed within DOD and what specific direction reform ought to take. Discussions have begun to coalesce around a number of proposals, including reforming defense acquisition processes, further strengthening the Joint Staff, reducing Pentagon staffs, and better empowering the services in the joint arena. Ideas vary, however, on how, specifically, to achieve those outcomes. Disagreement also exists as to whether or not reorganising DOD alone will be sufficient. Some observers maintain that a reform of the broader interagency system on national security matters is needed. This book is intended to assist Congress as it evaluates the variety of reform proposals currently under discussion around Washington.

Book excerpt: Arguably, the single greatest piece of defense legislation since the National Security Act of 1947 is the Goldwater-Nichols Defense Reorganization Act (GNA) of 1986. This piece of legislation reformed four major aspects of the Department of Defense (DoD), the Joint Chiefs of Staff (JCS), Office of the Secretary of Defense (OSD), the budget process, and Service organization. This paper will examine the interagency process that propelled this legislation to law. Because of the scope of this legislation, this paper will focus on the specific efforts to increase the powers of the Chairman of the Joint Chiefs of Staff (CJCS). It will show that Congress increased the powers of the CJCS for two reasons; first, in order to strengthen the advice provided by the military in the chain of command and second, to add greater scrutiny to the defense department budget. This action was the result of many factors coming together at the right time, spurred on by expert staff work, the influence of retired officers who highlighted service infighting and the involvement of powerful members of Congress.

Inherent in the ability to conduct joint operations is the requirement for the services to provided the unified commanders the forces, equipment, and doctrine needed to conduct effective warfare. Because of service parochialism and budget battles, needed resources are not always available to support the unified commanders operational plans. One of the major provisions of the Goldwater-Nichols Act was to increase the Commanders-in-Chief' input into the budgeting and force generation process. The purpose of this monograph is to examine the implementation of the Defense Reorganization Act, and see if it has improved the ability of the CINCs to conduct operational warfare. After extensive assessment, the author has determined that the provisions of the Goldwater-Nichols DOD Reorganization Act of 1986, has significantly improved the ability of the CINCs to conduct warfare.

To provide some necessary background, it will first look at the historic evolution of U.S. civilian/military relations and the changing roles of defense leadership. Then, using the comparison and contrast method, it will examine two periods on opposite sides of the law's passage - the Vietnam War and the Gulf War - to see whether the relationship between top civilian and military leaders was helped or hindered by this legislation. It will specifically conduct a detailed examination of the relationship between the Secretary of Defense and the Chairman of the Joint Chiefs of Staff (CJCS), along with a brief look at the roles of the Service Secretaries and the Service Chiefs. A major thesis of this paper was that the success or failure of most of these regional conflicts were driven not only by the personalities of the civilian and military leaders of each period but also by the evolving defense organizational structure. They are duel-hatted in their respective responsibilities. They have the inherent requirement to effectively provide the best military advice to the President, National Security Council, and Secretary of Defense as members of the JCS, while being responsible for the diverging responsibilities as the head of their service. This Strategy Research Project will discuss two major problems the Service Chiefs/JCS face in meeting their varied responsibilities: Parochialism" and "Time". During the discussion, the paper will review the challenges the Service Chiefs maintain in their duel-hatted responsibilities, and it will discuss the element of time they have to effectively accomplish their duties.
