Book excerpt: This study aims to, examine and analyze the history of gold dinar starting from the Prophetic era until Ottomans and to propose gold dinar as an alternative. In addition, this research gives a detailed study on economic and monetary integration among Muslim countries, nature of monetary currency, its functions and its evolution from the Islamic perspective. This study sheds light on the advantages and disadvantages of gold and fiat money and provides analysis of classical and modern scholars' view. The research relies on the analytical evocative methodology to achieve its objectives. It extracts several findings such as the differences of gold dinar weight during the Umayyad and Abbasid period, the views of classical scholars on the value of gold as a medium of exchange, measure of values and a means to possess other objects. The gold dinar has played an important role and successfully left an immense impact on the economy in both Muslim and European countries. Furthermore, it describes the view of modern Muslim scholars where most of them accept fiat money while some they prefer gold as money. However, the majority of the scholars are of the opinion that fiat money is the cause of the financial crisis in the world today. Moreover, contemporary Muslim scholars suggest implementing gold dÊnÉr by settlement of debt and using gold as a medium of exchange through the IDB and OIC channel. Finally, this research gives some suggestions to solve the problem of inflation and bring the stability in our financial monetary system and business. This is by proposing a suitable monetary system from the Islamic jurists' perspective for the Muslim world that will be protected from financial and economic crises and free them from servitude to the West due to the use of the fiat money monetary system.

Despite the destabilizing potential of the current monetary arrangements in the world, the return to gold is neither desired nor practicable. The Denarists, as some prefer to characterize the proponents, are palpably asking for the moon. It is argued here that the introduction of gold money in Muslim countries is in no way an Islamic imperative. And, if enforced, the system is likely to end in a chaotic failure. Sagacity, not emotion, must guide public policy.

No contemporary issue is more widely acknowledged and less understood than that of digital currencies. The voice of constitutional scholars, however, is crucially missing from prevailing digital money discourses. Private law scholars are grappling with the legal questions raised by digital currency models in property and contract. Public law scholars, by contrast, have yet to appreciate the significance of the moment. The challenge of understanding the technical dimensions of digital money innovations has obscured the potential constitutional revolution digital currencies represent. This book proceeds from the proposition that ‘money’ is best conceived as a constitutional phenomenon. When seen as such, it becomes clear that changes in the nature of money represent changes in political and constitutional arrangements. Explaining how, and in what ways, those changes will take place is the primary focus of this book. Through an examination of historical episodes where the nature of money has been linked to renewed constitutional settlements, this book distils a core set of principles linking aspects of monetary innovation such as technical control of the money supply to constitutional positions such as executive fiscal accountability. From these principles, a conceptual framework is proposed that translates the specific attributes of digital currency proposals into the language of constitutional dynamics. The book will be of interest to students, academics and practitioners with an interest in the law of digital currencies, constitutional law and politics.
