Book excerpt: Following the terrorist attacks of September 11, 2001, the Central Intelligence Agency embarked on a highly classified program of secret detention and extraordinary rendition of terrorist suspects. The program was designed to place detainee interrogations beyond the reach of law. Suspected terrorists were seized and secretly flown across national borders to be interrogated by foreign governments that used torture, or by the CIA itself in clandestine 'black sites' using torture techniques. This report is the most comprehensive account yet assembled of the human rights abuses associated with secret detention and extraordinary rendition operations. It details for the first time the number of known victims, and lists the foreign governments that participated in these operations. It shows that responsibility for the abuses lies not only with the United States but with dozens of foreign governments that were complicit. More than 10 years after the 2001 attacks, this report makes it unequivocally clear that the time has come for the United States and its partners to definitively repudiate these illegal practices and secure accountability for the associated human rights abuses.

Analysing the complex ways in which the U.S. government deploys law in order to consolidate and further colonial and imperial relations of power, Joseph Pugliese tracks the networks that enable the diffusion and normalisation of the state's monopoly of legitimate violence both in the U.S. and transnationally. He demonstrates how these networks of state violence are embedded within key legal institutions (US Department of Justice), military apparatuses (U.S. Defense Advanced Research Projects Agency), civic sites (McCarran airport, Las Vegas), corporations (Boeing), carceral architectures (CIA Salt Pit, Kabul, and Guantánamo), and advanced technologies (unmanned aerial combat vehicles). Law's violence, it is maintained, is always preoccupied with the body: its torture, extortion or extermination. The exercise of state violence, it is argued, must be considered in situated locations that evidence the enmeshment of the body within geopolitical configurations of bio and necropower. For it is in these locations that law plays a foundational role in enabling and legitimising regimes of racialised violence. Drawing on poststructuralist, feminist, queer, critical legal, whiteness and anti-colonial theories, State Violence and Execution of Law brings into focus the contractual imbrication of the state with arms corporations and the contemporary military-industrial complex.

Challenging this idea, Restoring the Global Judiciary argues instead for a robust judicial role in the conduct of U.S. foreign policy. With an innovative combination of constitutional history, international relations theory, and legal doctrine, Martin Flaherty demonstrates that the Supreme Court and federal judiciary have the power and duty to apply the law without deference to the other branches. Turning first to the founding of the nation, Flaherty shows that the Constitution’s original commitment to separation of powers was as strong in foreign as domestic matters, not least because the document shifted enormous authority to the new federal government. This initial conception eroded as the nation rose from fledgling state to superpower, fueling the growth of a dangerously formidable executive that today asserts near-plenary foreign affairs authority. Yet the governments of France, Germany and the United Kingdom are engaged in ongoing cooperation with foreign intelligence services in countries that routinely use torture. These European governments use foreign torture information for intelligence and policing purposes. And weak rules on the use of such material as evidence mean that it can end up as part of legal proceedings. Intelligence cooperation is important to countering terrorism. But regular receipt of, and reliance on, foreign torture information implicitly validates the use of unlawful methods to acquire information. The practice of using such information and public statements affirming the legitimacy of doing so risks creating a market for torture intelligence. It violates the positive obligation under international law to prevent and punish torture and can amount to complicity in such abuse. And using torture as evidence is a clear breach of the global torture ban. France, Germany and the UK can engage in necessary intelligence cooperation without undermining the global torture ban. To do so, they must make genuine inquiries with sending countries to determine whether torture was used to obtain it and what steps the authorities have taken to hold to account those responsible for that abuse. Cooperation should be suspended in particular cases where there are grounds to believe torture or ill-treatment were used to obtain shared information. There is also a need for tighter parliamentary oversight of intelligence cooperation, and stronger rules to prevent torture material from entering the judicial process. Europe has been forced to confront its complicity in US counterterrorism abuses, including hosting secret detention sites and facilitating extraordinary renditions. It is time for France, Germany and the UK to take responsibility for their role in overseas abuse, and to ensure that their intelligence cooperation does not perpetuate it."--Page 4 of cover.

This book argues that civil society actors, in particular, were influenced by nuanced differences in their national political and legal contexts that enabled or constrained human rights activism. It maps the conditions under which individuals and groups were more or less likely to become engaged when fellow citizens were tortured, focusing on national rights culture, the domestic legal and political human rights framework, and political opportunities.
