Separate property includes also that which the wife acquires by virtue of a right forming part of the separate property, or as compensation for the destruction, damage, or deprivation of an object forming part of such property, or by a juristic act affecting such property. 1371. The provisions applicable to the property of the wife under the regime of separation of goods (q) apply mutatis mutandis to the separate property; the wife is required, however, to contribute towards the expense of the joint household only in so far as the husband has not already received a reasonable contribution through his usufruct of the contributed property. 1372. Book excerpt: Developments of the law in Japan and in Germany provide ample reason for an inquiry into "The Identity of Japanese and German Civil Law". Japanese civil law has a long tradition of absorbing and digesting foreign influences, - in particular from Germany, France, England and the United States. The absorption of foreign influences occurred on various levels: at the legislative level, in particular during the drafting process of the Civil Code, at the judicial level and in the field of scholarship. The reception of legal theories was followed by a unique process that has been characterised as "theory reception" (Kitagawa). Irrespective of such foreign influences, we can discern a unique legal tradition in Japan - in other words, its own identity. At the same time, German private law is under the influence of legal harmonisation in the EU. While the predominant view in the 1980's was still that this development was confined to a restricted area - that of "consumer law" - recent developments demonstrate that European Union legislation now influences large parts of German civil law. What does this mean in terms of the identity of German civil law? And how does this development of a "Europeanization" of German civil law affect related legal systems, such as that of Japan? The present volume contains the proceedings of a conference held in Japan in 2006 to mark the occasion of the "Germany Year in Japan". FAMILY LAW CHAPTER 1: HUSBAND AND WIFE 1. Agreement To Marry 407. Mutual promises of marriage constitute an agreement between the parties described by the expression Verlobniss (betrothal), which, as regards the conditions of its validity and some of its consequences, is subject to the ordinary rules as to obligatory agreements. The remedies on breach of the agreement are, however, modified in the following manner: (1) an agreement to marry cannot be specifically enforced; a claim for pecuniary compensation arises, as a general rule, on breach of the agreement by one of the parties; (2) the pecuniary compensation is--except under the circumstances mentioned below sub (4)--limited to an amount indemnifying the aggrieved party for any disbursements made or undertaken in contemplation of the marriage, or for any loss incurred through any steps taken by such party in contemplation of the promised marriage affecting his property or occupation; the compensation is payable in so far only as the disbursements or steps in question were reasonable under the circumstances; a promise to pay a penalty in the event of a breach of the agreement is void; (3) the claim for compensation does not arise if the breach of promise is due to a cogent ground (e. g. the discovery of a legal impediment to the marriage, or of a circumstance which after the marriage would justify a decree of nullity or a divorce); if the ground justifying the breach of promise is a culpable act of the other party the party refusing to perform the promise is entitled to compensation from the party guilty of such culpable act; the rule as to the measure of damages is the same as in the events mentioned sub (2); (4) if an intending wife of previously unblemished moral character has...
