Book excerpt: Male-dominated law and legal knowledge essentially characterized the whole of pre-modern history in that the patriarchy represented the axis of social relations in both the private and public spheres. Indeed, modern and even contemporary law still have embedded elements of patriarchal heritage, even in the secular modern legal systems of Western developed countries, either within the content of legislation or in terms of its implementation and interpretation. This is true to a greater or lesser extent across legal systems, although the secular modern legal systems of the Western developed countries have made great advances in terms of gender equality. The traditional understanding of law has always been self-evidently dominated by men, but modern law and its understanding have also been more or less “malestreamed.” Therefore, it has become necessary to overcome the given “maskulinity” of legal thought. In contemporary legal and political orders, gender mainstreaming of law has been of the utmost importance for overcoming deeply and persistently embedded power relations and gender-based, unequal social relations. At the same time and equally importantly, the gender mainstreaming of legal education – to which this book aims to contribute – can help to gradually eliminate this male dominance and accompanying power relations from legal education and higher education as a whole. This open access textbook provides an overview of gender issues in all areas of law, including sociological, historical and methodological issues. Proposed reforms often have different implications for men and women. At the same time, traditional family and gender roles are changing with the decline in fertility rates and the rapid rise in women's participation in the paid labor force.While trying to adapt social security systems to the fiscal demands of aging societies, policymakers face the compelling challenge of how to design pension reforms that achieve fair outcomes for women. Gender and Social Security Reform examines how different countries are attempting to meet this challenge. Drawing on comparative studies of European and Latin American countries along with a series of case studies of individual countries, the book provides insights into the gender dimensions of alternative designs for reform. All of the countries studied have recently reformed or are about to reform their pension systems, with a clear trend towards tightening the link between contributions and benefits in order to secure the long-term sustainability of pensions. The book also alerts policymakers to other issues: Should pension systems be gender-neutral or compensate for inequalities in paid and unpaid labor? Does compensation preserve gender discrimination? Are unisex life tables a reliable or fair redistributive tool for women? Or should annuities be linked directly to life expectancy, differentiated by sex and potentially other factors? Now that survey questionnaires are able to record individual trajectories in greater depth, changes of status can no longer be viewed simply as separate events, but involve a transition process of variable duration. The observation, modelling and interpretation of these fuzzy thresholds between two situations constitute a dynamic field of research in the social sciences. The authors of this manual have pooled their experience of event-history data collection to address the questions of "focus", i.e. finding the right observation distance to grasp the complexity of life histories, and of time, i.e. choosing the right timescale of detailed information collection. After analysing the links between quantitative and qualitative data, addressing the distinction between facts and perceptions, and deconstructing analysis data categories, they offer a number of conceptual and methodological solutions. This study extends beyond the scope of specific examples to develop a major empirical approach in a still largely unexplored area. This book targets a much broader audience than the community of demographers alone. It concerns everyone in the field of social sciences who, at one moment or another, is required to organize data collection in the field, either for research or practical purposes. Moreover, it rejects the traditional contradictions between flexibility and security, blending the two into a single notion and thus depoliticizing the relationships between capital and labour. It shows that flexicurity fosters the further individualization of social protection, an increase in precariousness and the further weakening of labour in relation to capital.
