Developers are looking to the federal government, specifically the General Services Administration, for growth and safety. The General Services Administration (GSA) is the contracting body of the U.S. federal government. It is the nation's largest public real estate organization. It leases space from private developers in over 7,100 facilities across the United States comprising office buildings, border patrol stations, courthouses, warehouses, clinics, post offices and many other uses. The GSA pays over $4.6 billion in rent to landlords annually on nearly 181 million square feet of space. GSA is authorized by law to acquire, manage, utilize, and dispose of real property for most federal agencies. The thesis is primarily based on interviews conducted with industry professionals: developers, financiers, brokers, and GSA contracting officials. It looks at the opportunities and challenges of working with the General Services Administration on new lease construction build-to-suits. It focuses on four areas; 1) the lease procurement process; 2) opportunities for new procurements in 2009's market; 3) developer financed new lease construction build-to-suit projects; and 4) opportunities and challenges of financing projects in 2009's credit crunch.

In 2004, GSA awarded four contracts for national broker services (NBS). Performance of the contracts began on April 1, 2005. This report focuses on GSA's administration of the leasing contracts for the first contract year, ending March 31, 2006, and addresses, among other matters, (1) how GSA is attempting to prevent conflicts of interest in the NBS leasing program and to safeguard its information; (2) what, if any, savings have accrued to the government; and (3) how GSA is distributing its leasing workload among the brokers. To address these matters, GAO, among other actions, analyzed the contracts; GSA's contract administration guide; and GSA's policies, procedures, and controls related to these matters.

Book excerpt: Pursuant to a congressional request, GAO examined the actions that the General Services Administration's (GSA) Kansas City regional office took to procure leased space for the Department of Housing and Urban Development (HUD), focusing on why the regional office terminated the procurement on the award date. GAO found that: (1) the regional office cancelled the procurement because of an apparent inconsistency in evaluating properties located in the same neighborhoods during the market survey; (2) GSA personnel failed to document and timely review the initial market survey; (3) HUD officials stated that relocation by January 1990 was important because of fire safety concerns and an expiring lease; (4) GSA decided to keep HUD in its current space for an additional year because holding to the original occupancy date would have restricted competition to existing buildings; (5) the estimated lease renegotiation and extension could cost the government up to $570,000; and (6) GSA obtained the owner's agreement to extend the lease for 5 years, but the agreement allowed the government to terminate occupancy after 2 years with no additional cost to the government.

Book excerpt: This letter responds to your requests for a review of the data, assumptions, and conclusions reached by the General Services Administration (GSA) and the Patent and Trademark Office (PTO) relating to the acquisition of about 2 million square feet of leased space for the consolidation of PTO activities. This build-to-suit lease, valued at approximately $1.2 billion over its 20-year term, was signed in June 2000. According to GSA officials, the lease can be terminated without penalty to the government only if the lessor fails to perform. As agreed with you, the objective of our work was to respond to allegations and questions from two public interest groups about the PTO lease acquisition. One public interest group made the following allegations concerning the procurement process for the lease: (1) GSA improperly awarded the lease to an offeror who had not complied with the solicitation's stated requirements, (2) GSA failed to compete the construction of the interior finishes phase of the project as required by the Competition in Contracting Act of 1984 (CICA), and (3) GSA used an illegal cost-plus-a-percentage-of-cost contract. The second public interest group asked (1) whether the requirements in GSA's Solicitation for Offers (SFO) for the PTO lease transformed the lease from an operating lease to a capital lease under Office of Management and Budget (OMB) Circular A-11; (2) whether the new facility will be able to house all PTO employees and contractors throughout the lease term because the staff may grow, including whether this growth invalidates the potential cost savings from consolidation; (3) whether some of the standard requirements of the lease, such as a day care center and a fitness center, are essential to providing adequate office space for PTO.
