However, significant changes have already occurred in some areas, thus offering an opportunity to analyze the trends here and track the process of emergence of successor doctrines and practices destined to replace the Soviet heritage. The quartet of topics selected for treatment in this volume - the relationship between international and domestic law; citizenship and state succession; the Sino-Russian boundary problem; and cooperation with China in policing crime - illustrates major shifts in Russia's international law policy in a bid to shed the corset of Communist ideology and the old regime's modus operandi and join the international community's mainstream culture. The test cases also attest to the difficulties encountered in the process of transition and show that progress on this front has by no means been uniform. The sample includes both instances where the break with the past looks quite pronounced and where greater distancing from precedent might logically have been expected, but, for reasons that are then explored, a sense of substantive continuity instead prevails, albeit made more palatable by an application of linguistic cosmetics. From Soviet to Russian International Law: Studies in Continuity and Change marks the occasion of the author's 65th birthday and the 40th anniversary of his publishing debut.

Here in English translation is the Criminal Code and Code of Criminal Procedure of the largest of the fifteen Soviet Republics--containing the basic criminal law of the Soviet Union and virtually the entire criminal law applicable in Russia--and the Law on Court Organization. These two codes and the Law, which went into effect o January 1, 1961, are among the chief products of the Soviet law reform movement which began after Stalin's death, and are a concrete reflection of the effort to establish legality and prevent a return to Stalinist arbitrariness and terror. In a long introductory essay Harold Berman, a leading authority on Soviet law, stresses the extent to which the codes are expressed in authentic soviet legal language, based in part on the pre-Revolutionary Russian past but oriented to Soviet concepts, conditions, and policies. He outlines the historical background of the new codes, with a detailed listing of the major changes reflected in them, interprets their significance, places them within the system of Soviet law as a whole, and discusses some of the principal similarities and differences between Soviet criminal law and procedure and that of Western Europe and of the United States.

Book excerpt: Moving from the adoption of the "post-Stalin" Constitution of 1977 through its subsequent implementation under Brezhnev, Andropov, and Chernenko to the radical legal "restructuring" of the Gorbachev years, Robert Sharlet traces the gradual evolution of a nascent constitutionalism in the erstwhile USSR. Sharlet, a noted authority on Soviet law and constitutional development, demonstrates the gradual transformation of law from an instrument of Communist Party rule into the new "rules of the game" for nonauthoritarian political development. In effect, he argues, one of Gorbachev's most durable achievements may be his redefinition of Soviet politics into a legal idiom along with his relocation of policymaking from behind the closed doors of Party conclaves into the more open, emergent arena of constitutional government. In analyzing the politics of law from the Brezhnev era to the rise of Yeltsin, the author takes account of the "war of laws", the symbolic uses of the Soviet constitution, and even the fact that the leaders of the failed coup attempted to justify their seizure of power on constitutional grounds. Constitutionalism has sufficiently suffused Soviet public life, the book concludes, that most of the sovereign republics as successors to the former USSR, have begun designing their futures - to varying degrees - in constitutional forms.
